why new MP3 wont work?

Plug it in and it says malfunctioned, looked at loading disk it came with and says driver on PC is newer. Any thoughts? PC is about 2 years old. Tried also the lap top and same message.??

Send it back, get a new one.

Yes, it could be the USB driver on Windows is up the spout but best to try the simplest thing first before ripping Windows apart.
