Just received a letter from BiB stating I was doing 50 in a 40. I think It was done out of the back of a van. Once I've sent the letter back saying it was me driving is it worth fighting?

Didn't think your Landy was capable of 50 hehe

First question is do you honestly think you were doing the speed? If the answer is more than likely yes, then take it and move on. If you're sure they're wrong then there are good resources here to fight it but it'll probably give you an ulcer in the process. SCP's have the tenacity and morals of a rapist.

You can always ask them for the photo to tie up the resources a little more.

But if it was you, and know you speed like that, you are on a sticky wicket.

yes I was speeding had to get past a BMW! Thought I'd braked in time before he got me though rolleyes
How's does it work if I found someone else to be in my car at that time? Or is it not worth the risk?

it's not worth the risk (perverting the course of justice) - just take it on the chin and move on

Id naff them off

........asking for the detail of the person who taught the person using the camers equipment - to prove that he was an authorised trainer capable of providing certified training to the user etc etc

...then I'd ask for the equipment users training record to prove that he had been properly trained by an authorised trainer.

...then Id ask for the equipment servicing record

...it calibration certificate

...and records to show that that on setting up that all of the relevant procedures had taken place (ie it was sighted in the correct position etc etc)

I know some sound stupid..but I am sure there was a relatively recent case where a drunk driver evaded prosecution because it turned out that he argued that the officers conducting the test had not been trained by a person who had recieved certificated training from the manufacturers etc..or something like it........

Exactly. The more people who fight these, the less money they will make. And that can't be bad, as SCPs lose more money...Who knows, at some stage it might not even become economically viable for them and they will target something else.

Agreed, but as others have said, definitely don't attempt to pervert the course of justice. The fact that justice is already perverted is not accepted as an excuse.

However it's Matt who has to get the ulcer fighting it....

IF it's wrong then of course fight it every step of the way and endeavour to let truth prevail... Spending months fighting off a £60 fine simply isn't worth it though if you actually were speeding in the first place.

But, was the driver speeding? Some checks woldn't be out of place.

Drivers are expected to be aware of the law, so should local authorities, but there have been several 30mph and 40mph limits in which drivers have been criminalised, where no limit actually existed. Because the relevant traffic order was absent without leave, or out of order, or the wrong legislation was used, or the signage was illegal because part of it was missing or obscured or not illuminated, or some other issue where officialdom acted outside the law. Why is making such enquiries at the offices of the relevant authority not legitimate use of time, when those authorities have shown incompetence and ineptitude in the past? There are other matters to contend with but that will do for now

Yes, ask for as much proof as possible, we're all entitled to that. That's minimum effort for you and maximum effort for them to earn their salary and bonuses.

no it wont work - it'll just go against you when you get to court - you're caught bang to right and then you argue - all that will happen is you get the maximum fine not the minimum (fixed penalty) - get yer cheque book out

No it can be done you are entitled to see the evidence against you etc(that one of the reasons they offer you an oppertunity to see the footage/image and on some occasions send it with the summons...and if it transpires whilst they are checking for the information requested that there has been an "error" you can bet you backside it will be quietly dropped!

Obviously if you get the requested info and everything is spot on as per procedure ie training records correct, callibration etc etc..then you dont have a leg to stand on..but otherwise you are entitled to ask.....

Lets face it if someone sent you a letter claiming that you had done something..wouldn't you want the proof and or all of the available info before you responded....

drivenmad is absolutely right. You are entitled to see all the evidence against you - exercise that right.
