Hello chaps - this evening I was pulled over by thetraffic police for speeding. I was caught bang to rights at a considerable speed over the limit. Instead of taking me to court, the policeman gave me 3 points and a 60 quid fine. He was actually very reasonable - he stated that he had used his discretion as I was not posing a danger (there was no other traffic whan I hooned it, but I was so far in excess of the limit that he decied to pull me. As an aside he seemed to be an enthusiast as he liked the car and had a brief chat about it! Still decided to give me the points. Bugger.

Any way, I have to produce my licence at a station in 7 days. Only problem - I have just ripped my house apart looking for it and cannot find it; I am sure it was lost in the move a couple of yars back. What the hell do I do? And am I now going to get in even more trouble? I have had a valid licence for over 10 years, car properly taxed and insured etc etc. Licence is clean so I dn't have a history of this sort of thing.

Any suggestions? Or am I royally screwed...?

Can you remember you licence number?

That may suffice...

I think the format is

First five of surname (packed with 9s if shorter than 5)

DOB in format YDDMMY (I think, Days and Months could be the other way around)

Initials (3, packed with 9s) and then two random digits.

Phone the DVLA. Even if you've lost yours, they should have a record of issuing it.

Not a problem just produce your MOT & insurance within the 3 days, explain you have lost your licence and are applying for a new one, they may check with the DVLA you have one /status, they may not, as you do have a licence you are not transgressing any laws.

so long as you go see the cops and explaine and now (not later) sort a replacment with DVLA you should be ok. The law has ways of checking us now (in car links to DVLA etc) so just sort it now and they will be ok.

Wouldnt worry about it too much, cops may; when 7 days are up and you attend to produce; "give" you an "extension" (they dont really have a lawful power to do this(legislation only says within 7 days of being required to produce)

...but they do cause it saves some grief and hassle for them. As long as it has been said that you tell them and you do contact DVLA and apply for a duplicate etc etc.....

They may do a PNC check to confirm that you have one and that will be suffice for them

....problem is you need to produce your licence to have it endorsed for the offence...

....Worse case scenario (assuming you get a jobsworth) is that you attend without licence do all your explaining and they decide to charge you for failing to produce(they can)

....I wouldn't panic or worry about that statement, because by the time he writes the case etc etc and reports you

...your duplicate licence will have come back from DVLA (cause you did apply for it) and you write to local CPS/PFs office and explain circumstance including a copy of your licence (offering to produce original in court should they continue and still require it)

....what will happen is that CPS/Pfs office will write to jobsworth and ask to check the details contained on your copy of your licence

...which will cause him to do his PNC check , which will so you have your licence, which would mean it was a complete and utter watse of time jobs worth charging you

...so case gets dropped!

Dont worry.

I wouldn’t worry Harry. Had a similar thing happen to me (insurance cert).

They weren’t overly fussed. As long as you go cap-in-hand.

a) They can check straight the way
b) If you act/look half decent they won’t be locking you up for the evening.

Call DVLA .. they will be able to trace from name und address... only you should have notified them of this change when you moved .. yikes Give them your former address to help them trace you und pay for new one with trusty plastic over the phone - assuming you already have photo card version already.

I assume ist the folio which ist missing if you have the card version.

If you already had paper one. get photo taken und pay extra £2 for post office to check your passport to verify identitity und likeness to photo und they will send application to DVLA for you. This unfortunately take 7 days so I would notify police of your licence number as they should be able to verify you have one on that database we keep hearing of on "Traffic Cops" .. und also take with you copy of application for new one .. or debit card transacation for replacement. I am sure they know this happen when you put "something in safe place" und then forget all about it in stress of move.

You need to get thing moving asap though

Same thing happened to me, I turned up at plod shop with all docs including photocard part of licence but not the paper bit. This wan't good enough and as the DVLA couldn't supply a replacment withing 7 days, plod bird at the station said it wasn't a prob but I'd have to get a new licence and show it at court.

Court details turned up saying that I could send my details in, I did so and got them back with 5 points instead of 3 and 90 notes extra fine.

Good luck

If it's not accepted by the police, what's the point of the photocard licence?

Failing to produce does not carry any points. ^^^^^^^^^^^^^

Under the Sectioon of RTA 88 requring production of DL there is an inbuilt defence:

In proceedings against any person for the offence of failing to produce a licence it shall be a defence for him to show that—
(a) within seven days after the production of his licence was required he produced it in person at a police station that was specified by him at the time its production was required, or
(b) he produced it in person there as soon as was reasonably practicable, or
(c) it was not reasonably practicable for him to produce it there before the day on which the proceedings were commenced,
and for the purposes of this subsection the laying of the information or, in Scotland, the service of the complaint on the accused shall be treated as the commencement of the proceedings.

The purpose of the Section is to ensure that persons driving hold a Licence.

Any Plod worth his salt can by a simple interrogation of PNC gain information as to Licence status. But these are modern times I gather and performance indicators may influence a report to up the fiqures.....

Sound advice not to delay matters and take what one has and explain the problem and DVLA contacxted to provide a replacement.

My book its a constipated officer if he takes any action on fail to produce if Licence in order.

That's what I thought the purpose of a producer was.

As far as the forms that she had to fill in, she said that without seeing the paper licence she couldn't complete the form and had to send it off saying I hadn't shown my licence. The court then awarded an extra 2 points. Just wished I'd turned up now as I was told it would simply be a case of handing over the licence and getting the endorsement.

Ah, but by NOT being able to produce...

You seem to HAVE to go to court...

And the dim magistrate can (and usually does) give you far more fine and points than the std fixed penalty...

This was designed to free up courts...

But in this case screws the unlucky as we didn't want to bloody go !

What evidence did you provide in court to show that you were unable to Produce ?

That isn't the point...

The point is that if you can't produce...

You have to go to court...

When you go to court...

Their guidelines are MUCH harsher for the speeding offence than the std £60 / 3 points.

They aren't fining you for not producing as such.

Sorry for the thread hijack but I wonder if this finally explains why I got off after being stopped for 97 on the motorway 2 years ago? Overtook an unmarked car, got pulled over by a really nice chap who said he'd measured me at 97 mph over whatever distance etc. He said he'd deal with it by way of a £60/3 pointer - I thanked him genuinely and looked totally relieved. Anyway, we had a nice chat about loads of stuff and I mentioned I was off skiing first thing in the morning (it was 1am when I was stopped) and that I wouldn't therefore be able to produce my licence within 7 days. After a bit more chat, he told me to drive home feeling very lucky and tell my mates that the police weren't all bad. No action taken.

It's reading this that I realise that he did that because otherwise it would have to have been a full monty court job which could have been much worse than £60 / 3 points?

So I probably very nearly landed myself a court appearance by getting caught speeding a few hours before leaving the country for 10 days!
