this morning was in court for my case of 107.4 mph on the M6 near penrith, was given a ban of 21 days, fined £275 which seemed fair enough, they said they would endorse my licence and send it back to me, but no mention of points at all, does this mean i wont recieve any points? and if i do, will they count in the totting up proceedure if iv had my ban.

cheers

Doesn't sound like you got any points.

However, if you did, they would stay on your licence and count towards totting up for the next year 3 years. I think they only get wiped out if you get banned under the totting up rule for having reached 12 points in a given three year period.

ETA: The endorsement will be in respect of the ban - that is entered on the licence in the same way as if you had, for instance, got 3 points for an SP30 following a Fixed Penalty Notice.

If you're banned as you have been, you don't get any points. I was banned for 28 days in 1998 for speeding on the A66 near Barnard Castle. Same thing happened to me.

Oh, and your name will be in next weeks Westmorland Herald!!

So what is worse, 9 points or a short ban, insurance wise?

Glad you got a decent result. My bro was hit with a 3 month ban, but smaller fine than you, when caught at 104.5 by Perth. He pretty much had the book thrown at him as he was only 21 too.

Hope the insurers aren't too bad about it.

If you need a lift anytime to town (or work) feel free to ask. Only downside is that you'll have to brave the Smart

Good result m8 and not a hefty fine

A ban does not incur penalty points
Penalty points would only be incurred if you had been answering other charges.

Better to accept a short ban than ie 6 - 9 penalty points. Often "played" that way when presenting the case to the mags.
Otherwise, by accepting penalty points the "totting-up" procedure could have incurred a ban + fine & in the long term a worse situation for you.

How long a ban do you get through a build up of points? Is it fixed?

I thought that when banned for 55 days (106mph - nice to see the consistency) - got my license back with no points. About 18 months later, when swapping my paper license for a photo version I got it back with 6 points on it all of a sudden. The court never mentioned it, but the court records show the points were given. I'd double-check with the DVLA.

When I phoned Direct Line to let them know, when I queried the fact that the insurance hadn't gone up at all the guy on the phone said "Well, it was only speeding wasn't it?". You might get lucky.

Does that mean they can't do both, or just didn't in your case?
I had to go to Selby court (apparently one of the two harshest courts in the UK).
Super.....

Sorry to revive an old thread, it seemed to make more sense than starting a new 1.

If someone is given a ban for say 21 days, do they need to inform their insurance company, particularly if not points were given?
