I chap I know, lets call him “Dick”, decided one day it would be a good idea to create an E out of the F on his reg plate using a bit of tape, so he could drive with much haste cross-country on some urgent business.

Smile! <FLASH> Smile! <FLASH> etc etc

Some poor sod in Glasgow got the tickets.

Dick forgot to remove the tape afterwards, and after a fine display of fvck-wittery in front of BIB (an ill-advised overtake past a lorry head-on to a marked car) found himself at the side of the road after they came back for him.

Honestly, you’d just throw away the key right there wouldn’t you, but it gets better.

The astute BIB spotted the tape on the rear plate and twigged that the V6 Clio he was looking at really didn’t fit the description of some Scottish Van. Ello ello ello etc etc and whilst he was going about his business our chum nipped round the front and whipped off the other bit of tape and shoved it in his mouth to chew on gum-style.

Clearly BIB is wondering what kind of asshat he has here after Dick explains he didn’t do it guv, it’s a fit-up. It must have been my mate Bert he said, who had the loan of my car recently.

Enquiries were made with Bert, who had some sense and denied having anything to do with it all.

Dick now has to present himself to the court in a couple of weeks on a charge of Perverting The Course of Justice. Not good.

Is he going down do you reckon? What says the sharp legal minds of SP&TL? He’s a list of traffic priors as long as your arm to boot.

Has he thought through his defence ?

I mean, when his own defence lawyer says:
"Your Honour, he can't help it - he's as thick as a box of hair"
will it help ?

Oh yes it is.

The offence is commited where a person or persons acts or embarks upon a course of conduct which has a tendency to, and is intended to, pervert the course of public justice.

From the court of appeal it includes

"conduct which relates to judicial proceedings, civil or criminal, whether or not they have yet been instituted but which are within the contemplation of the wrong-doer whose conduct was designed to affect the outcome of them. That conduct includes giving false information to the police with the object of among other things putting the police on a false trail."

I must agree with this. I think that the most apt outcome would be for the CPS to investigate all of the tickets that were sent to the wrong person and 'reapply' them. However, it does seem to be hit and miss as to whether the CPS can be bothered to spend that much time on a case... so we will wait to see what happens to "Dick"!!

"Dick". What a singularly apt nom-de-plume.

Does the person providing the false information have to have previously cautioned for the possibility of Perverting the course of justice to apply?

This is Perverting the Course of justice, I'm afraid.

And given the recent case where a bloke tried to wriggle out of a ticket by swapping road signs who got custody, and also given the fact that the motorist is currently the pariah of society, I'd say he's looking at custody for this, especially as he has previous convictions.

It's not like he did it on the spur of the moment is it?

I suppose it depends what he has admitted to.... If he maintains his innocence then it really is hard to prove beyond all reasonable doubt that HE was the one to put tape on his number plate, given number plates have unrestricted access. Although the least said the better, in that one can protest too much in these cases and talk their way into guilt!

Otherwise throwing himself on the mercy of the court will probably see (assuming no other ag and other convictions) a fine and community service...

I would guess he was cautioned at the scene - yes?

Bloke that got the duff tickets will be fine, but that fact doesn't mean that the other guy hasn't commited the offence of PCJ.

A Scottish case at last. Eh he's stuffed. Uber daft this one.

There is no CPS to feck things up. The Procurator Fiscal will prosecute. I would expect him to be dealt with at summary level in a Sheriff Court or a District Court but presided by a Stpedury Magistrate. They have the same powers as a Sheriff. There will be no jury just the PF, council for defense and witnesses.

This is a common one and annoys the hell out the Sheriffs. The PF is an expirienced lawyer and can perform a bit in court because the sheriffs see them every day. Generally they have been defense lawyers and know all the excuses.

Jail would be daft. Sheriffs don't like giving the jail unless they have to. A fine would be more in order. £250 at a guess possibly less if there was an early plea.

Points? Possible but maybe not.

The Glasgow defense lawyer will know which Sheriffs are hot on RT law and which Sheriffs are heavy handed.

remember Glasgow Sheriff Court is the busiest court in EUROPE! Any plea is looked on favourably.

Dinnae dae that again. He's lucky us Glasgow polis never stuck the nut on him! : - >
