can anyone help?

Got 3pts and a producer over the weekend (first for years I might add). Bit worried because we moved in the autumn, and as luck would have it, I clean forgot to get my license updated with my new address information. Along with that I cannot for the life of me find my paper license. All I have is my card license, which has our old address on it.

Apart from sending off for a new license PDQ, could anyone advise me what to do regarding the producer? Should I take my card license (with old address), or should I just go along and say I've lost my license and have sent off for a new one (which will take longer than the 7days)?

Any ideas?

cheers

Take your licence, with the old address, and let the Police send it for endorsment. The very same thing happened to me in Autumn 2005. They'll return the licence to the address you gave at the time of the offence, rather than that on the licence.

Once you've got your licence back, it's free to send away and get your personal details changed.

If you fail to produce your licence within the 7 days (even for a change of address) it's highly possible you'll have to face court to explain why. You might not face additional points, but it might cost you time and money.

That may get you in trouble, as they'll need that to put the endorsment on. If you really can't find it, I'd pop down the local station and explain your circumstances, see if they'll wait for the replacement from the DVLA.

It might be better to get the complete licence and then go to the nick. I understand some forces don't bother if it is a little late.

They cannot process the FPN as the Licence AND THE COUNTERPART are required.

Visit Plod shop and explain before the 7 days are up. They may be lenient and extend production date to enable you to get the Licence (corrected) and counterpart from DVLA so that FPN can go ahead.

Otherwise it is a Court appearance.

Just out of interest, say I wait until I get my updated license through the post, thus missing the 7-day period. Then go down to the plod shop when I have all my docs and use an ickle white lie like "I clean forgot"

What then?

You'll probably get done for failure to produce. However, if you go down and explain the situation, they may well extend the time given for you to produce.

Sorry about this but it seems to be accepted that if you get a FPN plus HORT/1 the bureaucratic process gives you no option but producing your docs, surrendering your licence and opting for payment of FPN within 7 days.

I understand that under RTA 1988 s137 and given a HORT/1 in a situation that one is reported for committing an offence for which a FPN can be offered, one has 7 days to produce licence etc. Where a FPN is 'part B' of the HORT/1 surely one has 21 days to accept ( or opt for summons and court) the FPN under RTOA 1988 S51 (3) a) being

(a) the period during which, by virtue of section 78(1) of this Act, proceedings cannot be brought against any person for the offence to which the notice relates, being the period of twenty-one days following the date of the notice or such longer period (if any) as may be specified in the notice (referred to in this Part of this Act as the "suspended enforcement period" ),

Have I got this wrong ? Grateful for DvD or others advice. I was aksed this quetion for someone else who finds himself in this position today.

just an update:

Went to the plod shop, told an ickle white lie that I lost the paper part of my license during our home move (which is probably what really did happen). they phoned the central ticket office, who were happy to give me an extension whilst I wait for my new license to come through. When it comes through I can then send the original producer along with the licence direct to them.

Woohoo...
