Apologies if someone has had this query before, I've tried a search, but can't see any...

Very quick summary:

Flashed by a scamera van on the A3 on 13/10/2006 (70 in a 50)
Recieved NIP on 20/10/2006, and filled out admitted I was driving

Nothing for the last 3 months, then, on Friday, recieved another NIP, dated 25/01/2007 for the same offence.

Obviously, if I hadn't received the first NIP it would be past 14 days, but since I've had that first one I'm not sure what to do. Should I write back telling them it's over 14 days and FRO, or admit to it AGAIN!?

Did you cough up and get the points on your licence? If not, I'd be tempted to tell them to go away on the baiss that this NIP is out of time..

I admitted it on the first NIP, but haven't heard anything since.

Think a letter telling them they missed their chance is my most likely response!

Ignore the second NIP if it is a complete new one they have raised for the previous offence.
Sounds they are "trying it on" as they were too slow in actioning the first NIP.
14 days + 1 day post is the required time.

Looks as if you have got away with it, well done if you have

I thought they had 6 months from the original NIP though?

Was annoyed at the time I got done tbh...if you know the A3, it was just after the point it goes down to 2 lanes (and down from 70 to 50), by Hook. There are 2 speed cameras in the first 1 1/2 after the limit reduction, and I was caught by a scamera van they'd put in between the 2!

Was Friday the 13th as well!

Surely you can only respond to the facts. I would write stating that the NIP is invalid and see what they say.

They've probably lost the one you sent back.

I think the go forth and multiply response would be in order. (IANAL!!!) Send it back stating that it is now x weeks since the offence, and that by your understanding that is too late to send a NIP.

If you had been caught by all 3 cameras and sent NIP's for each, then you have a very good defence to be only charged for 1 speeding offence as it was within the same journey & stretch of road.

There is no requirement to respond to the 2nd NIP...don't go there....unless you want to open a can of worms!!!!
Another one will arrive in the post within 28 days if they are stooooopid enough to persue it. They won't is my reckoning.

Sit tight, leave it well alone & have a smirk

No way I would have been caught by the other 2, I know them well!

Couldn't believe it when I spotted the van lurking under a bridge between the 2.

If I'd been pulled at the time I could have told them I was merely keeping up with traffic, which I was...they must have made a fortune that afternoon!!

I think if you dont respond you will be done for S172.

you will need to prove you responded to the first, regardless of what any law says.

best thing is say it's out of time imo, and see what they say.

Absolutely agree.
Don't ignore it, just return it with a note pointing out when the offence was and stating that it was not sent within the required 14 days. Then sit back and see what happens.
