Hi all,

I have SORNED my car as it is currently not running. It is locked up in my garage. Do I need to keep this car insured? I have bought another car to use while I decide whether to fix it or not, but need to know whether I need to keep a policy going on the SORNED car.

Cheers

If you are not using the vehicle on a road or public place then there is no need to insure it for road traffic purposes.

Different matter if you want to insure it for theft under household insurance policy.

Coming shortly under Road Safty Act will be a requireemnt to notify MIIB that it is off the road like SORN and Excise.

I read last week that the government had introduced a law that insurance for motor vehicles had to be continuous, even where the vehicle was parked off road on private land. Those registered keepers of vehicles that did not continue to insure vehicles, would first receive a £100 fine, then followed up with vehicle being clamped or towed away and disposed off.

The intentions by the govenment of the above is to lower the number of uninsured and untaxed vehicles on UK roads.

That's what DVD is talking about.

There has to be an active policy on the vehicle, unless it has been SORN'd.
No SORN & computer shows insurance expired = FPN.

Von is saying UNLESS it has been SORN'd I guess if its off road and untaxed you tell the DVLA that its sorned. Same as will be for Insurance, i guess you would have to declare it as uninsured.

Vehicle on a road with Insurance equivalent of SORN = ticket.
Not notifying of No Insurance = fine
Vehicle on road and showing insurance not held = ticket.

I dont htink its to make you have insurance 365 days a year on every vehicle its to ensure that you now have to declare no insurance same as you have to decalre no tax for off road purposes.

So if your insurence expires when you are away out the country, the car is in your locked garaged, you arrange for cover to renew from the date you return, that gives you a fine unless you have told them its uninsured.

So who do you have to tell? Or do you have to SORN it? To Sorn in the above situation seems a bit of over kill, especialy if your tax had not run out.

So when does ( or did ) this come into force.

On a similar note, when does ( or did ) my radar detector become banned?

So what we now need is a new law - giving citazens the right to clamp government vehicles nt showing a VED cert and empowering drivers to order govt officials ( including police)to produce docs at a police station within 7 days.Could call it "the oficial rwturn to sanity law(or the motorist strikes back)"

There are ideas within government today that wish to see an early intervention to prevent crime, that is to restrict civil rights by foreseeing that some sort of offence could occur. The untaxed/uninsured motor vehicle is one example where the law enforcement agencies do have the ability to track circumstances which are likely to result in an event/offence.

What one needs to ask, is what DVLA and possibly other government departments may do, before something occurs, can intervention be justified? An assumption of intentions of wrong doing/guilt.

So Von, as it seems to have been stated both ways thus far by yourself and by another well informed contributor on an earlier thread, would you please answer the following hypothetical question -

As of today, 05/02/07, my vehicle is still taxed, but not insured. It is off the public highway in my garage, where it will remain until it has been re-insured. Am I due to receive an automatic FPN for my crimes?

This database that hold details of insured cars that HMG will use to send you a FPN - is this the same database that the BiB use to haul you off the road because you apparently have no insurance but which you do in fact have (but the database hasn't been updated yet)?

If it is then there will be a rising number of challenges to these FPNs!! banghead

Section 22

nutshell to what is being discussed:

condition is that-

4(a) the registered keeper is at the relevant time the person keeping the vehicle,
(b) at the relevant time the vehicle is not used on a road or other public place, and
(c) the registered keeper has by the relevant time complied with any requirements under subsection (7)(a) below that he is required to have complied with by the relevant or any earlier time.

(7) Regulations may make provision-
(a) for the purposes of subsection (4)(b) and (5)(c) above, requiring a person in whose name a vehicle is registered to furnish such particulars and make such declarations as may be prescribed, and to do so at such times and in such manner as may be prescribed.

As Von states STat Reg to bring this in yet to be made.

So if I sell a car to someone and they do not bother to send of the V5 or insure it, then I end up potentially being liable.

Seems flawed!

It's your responsibility to complete and send off the V5.
