Cats eys heights

Can anyone help?
I was out in my Westfield FW400 some months ago, and my sump hit a cats eys. Luckily, only the sump broke - my mate was following closely on his Ducati 916 and had a wobbly moment!!
I have tried to claim off highways. I have photos showing the cats eye to be about 30mm proud of the road.
Highways say they should be no higher than 25mm, and they say the cats eye I hit is only 24mm proud of the road.
Does anyone have any info on how much this critical measurement can vary between a hot and cold day. I did this around October on a very mild day (say 15 degC) and they measured in January (say 1 deg C).
Any help much appreciated.
