Daughter caught speeding last night.
Discussion
Daughter has only been driving for 2 months, and was travelling up Reigate Hill, which is a 40MPH zone which goes into a 30 for a bit and then back to a 40. Policeman jumped out from behind a bush in the 30 zone and flagged her down. She was apparently doing 40MPH. She was a bit dubious about stopping because she wasn't sure it was a policeman as he didn't have a hat on, but she did. He then went on to tell her she was doing 40 in a 30 zone, although there is no sign saying it was a 30, she argued that the stretch of road was the same as where she had just come from, with pavements and street lights, how was she to tell the difference. He then told her that she didn't have a full licence, to which she replied check on my insurance details.
I don't think this was a fair cop, she want's to go to court as she doesn't want 3 points on her licence this early. Is this a good idea?
Thanks for any advice you may be able to give.

First thing I would do is go back and check where she was stopped, and whether or not there are 30 signs at any stage to confirm if she was speeding.
anywhere road where there street lamps and no signs carry a 30mph speed limit - she's just recently passed her test so this should be fresh

The stretch of road that is 40 has got streetlights, so has the bit that is apparently 30, with only signs to say it is 40mph how do you know it suddenly becomes 30.

I don't know the road have a drive down there yourself and have a look for the speed change sign
I know the road, although not sure which bit she got stopped on.
Coming down the hill from the M25 there are signs at the top saying its 30mph, once passed the first junction it is signed at 40, and then it reverts to 30. But as there are street lights it only needs the initial 30 warning sign and no repeaters.
Do go back and check it, as you never know the initial sign might be missing.

You say she was doing 40 in a 30 and got done for it - I don't understand what is unfair about that. Quite probably not unsafe or in any way necessary but still 40 in a 30 is breaking the law...
So is shooting Tony Bliar but no-one would complain if that law was broken... Would they?

But if the laws an arse it's your civic duty to break it.
How many people have to think the law in question is an arse before in your view the above applies? Or is it just down to the individual?
Some laws are just plain unenforceable. I read in papers that West Yorks, GMP, und others are not enforcing the child seat law as this compromises "child's human right in being measured with a tape measure"
( ist what the police were all quoted as saying
Und the others.. we read that talking to passenger, tuning radio, looking at something other than road ahead (how does speedo check/mirror check fit in with this one
) .. all class as "d-d-d-dandgerous
Und how can one even prove this was going on in car..
Ach.. the black box of course... ist another reason to
und sign that petition before too late

I suggest the pair of you go out and drive the route again. There has to be a 30 sign at the start of a 30 limit. In fact I think there has to be one on each side of the road.
Check the road, make sure there is no 30 sign where she was caught.
Then, throw herself on the mercy of a judge. Inexperience meant she didn't realise that it had gone from 40 to 30, she was REALLY trying to drive the best that she could. Points would cause years of insurance premium hikes so if he could pass on the points, give her a fine, then she'll go back, study the highway code and try a lot harder from now on.

One is enough when the law is arbitrary and the so called crime victimless.
I don't see why a gang should be viewed as having any greater moral rectitude than one person of good conscience, especially when the gang is indistinguishable from any other extortion racket.

I am interested if you apply this thought process to say personal property?
