Do I have a case here?

Driving to work this morning, turning right at a roundabout to join dual carraigeway. Some dosy driver doing 15-20 round the (big) roudabout, so as I join the DC I undertake her and proceed. Flashing blues behind me, I glance at my speedo it says 41mph. 50 yards ahead is a 40mph sign. I think I'm OK. I think wrong.

So now I'm done for drivng without due care, and speeding (apparently I was still in a 30 zone, 40mph zone starts in 50 yards). Plod is a real old school hardass with fresher PC in tow. They admit that I am much more likely to be stopped "in a car like that" (BoxsterS). To which I take offence.

Meanwhile cars pass us at 50+mph. So he asks me for my 'statement' and then half way through he resuses to write any more saying it's too long. I ask him to finish my statement with "I can't say any more because the officer refuses to write it". but he refuses to write that too. Then he wants me to write down an admission that I was speeding, I refuse, he then says he will do me for purgery when it gets to court if I deny I was speeding.

Any thought fellow PHers?

No and No!

If you are exceeding the speed limit then you are exceeding the speed limit, regardless of how close you are to the boundary.

The opinion of 2 plod is all that's needed to convict (VASCAR over the 0.3M not needed).

Have you actually been "reported for consideration of the question of prosecuting you" for this offence?

His conduct at the roadside sounds very iffy.

From what you're saying, he was probably not being Porsche specific. I suspect any similar sports car would have got the same response.

Seems he was trying to create the right impression for the fresher cop. Guess he got more and more pi55ed as things went on when it didn't turn into a simple "cuff me guv, I kill small children confession".

But if you were speeding, in front of a Police Car (marked?), undertaking too, then he has every right to prosecute.

Unlucky though.

Was the junior police officer in his charge of the opposite sex?

Sounds very much like he was trying to impress someone.

He'll do you for perjury indeed, what a twunt.

My speedo is out by 4-5mph, so the actual speed would've been 36-37mph.
Isn't there something in the Highway Code that allows me to pass a vehicle going unnecessarily slow for safety resons, briefly going over the speed limit, as long as I quickly retun to the legal limit?

If this is an accurate summary of what was said, then you need a solicitor. You should be able to get him into trouble.

Nope. Even at 36MPH, you're still over the "10% plus 2" ACPO guideline, and hence eminently nickable.

Plod need not abide by 10+2 threshold

Quite so. Salient point, though, is that there's no exception for civvies, in any circumstance.

Second memo.

Dont tell him. That will only make him be *exactly* by the book. Secondly, whether you warn him or not the standard should be the same.

Would a covert recording stand up in court?

I read the other day that any speed measurement should be over a minimum 1/8 mile or 0.07 mile in exceptional circumstance.
