Just had a visit from the very not so nice man from Drakes bailiffs.

Came round to serve me with a warrant for unpaid parking fine i receied back in September.

Now the problem is, as far as I was aware I had paid this already back in December. Admitidly a little late I know and it had gone upto £45 from £30 at this point.

I phoned up, left my bank card details on an answerphone in December and that's the last thing I ever heard about the matter until half an hour when some toss pot turns up at my house demanding £200 or goods to the value of etc etc. So in the time period they have taken my case to court - without telling me - Oh, that's what they do sir! Not written to me once to say they still have no payment - Oh, that's what they do sir!

Well OFF - this is unbelievable that this sort of thing can happen like this. Fair enough I should have paid it straight away but for a fine to reach £200 without my knowledge or any communication is just ridiculous. Time to follow some magistrates out of court, note there car reg numbers and start clamping the ing idiots own cars for no reason.

I think I'd be speaking to the clerk about why the court papers weren't properly served.

Council or private parking?

council - totally my own fault and i knew i would get a ticket - I had parked outside a pub only about 3 miles form my house. it's a small back road with double yellows but causes no obstruction to anyone parking there or anything. I usually park there when i pop in for one after work. That night I popped in for one which turned into 8 so of course got a cab back home and left the car knowing full well chances are i would get a £30 ticket so thought rather have that please than drink and drive etc etc.

I completely forgot about it and then got a reminder - now gone upto £45 so thought, whoops, better pay this now. I phoned up over the Christmas period, office shit answer phone and left my card details as requested. That was honestly the last thing i heard so i assumed it was all fine. Bailiff turns up this morning, apparently they just a run a court case and judge it without even telling you! Nice, thanks a lot.

Thing is though, how much other post is going missing too? not just on this subject.

Sounds a bit coincidental that probably three or four letters have gone missing, especially coincidental if those letters just happened to be on this subject. Or maybe the address on your V5 isn't quite correct?

Similar thing happened to me, car was off being sprayed, and the sprayers left it out on the road while moving other cars around, and it got a ticket, they never told me. First thing I knew about it was bailifs turning up at my house on CHRISTMAS EVE!!! demanding a stupid amount of money (can't remember how much, over £300) saying they sent me several letters (a lie) etc etc explained that the only way I could have got a ticket was when the car was at the sprayers. of course they didn't care, take it up with the council etc. Then said if I didn't pay they would be back tomorrow!!!!!! when I had the whole family over inc in-laws and it be another £180.

Reluctantly I paid up using my switch card, where they made me pay a surcharge for using a card FFS

complete and utter tosspots.

The bailiff said they don't send you anything! That's why I'm so irrate!

I told him that I had not received a single letter about this and he said, they don't send out anything. You have a certain time limit to pay within, if you don't pay it just automatically goes to a court case at the local magistrates, they then issue a warrant for the value and just automatically send round the bailiffs. No communication at all. He even agreed that the situation is crap but that's how it's done.

Doesn't sound quite right to me. You have a right to defend yourself at any hearing, unless it is deemed ex parte (i.e. an injunction to prevent you selling off assets, they wouldn't want you to know). A Bailiff won't always tell the truth I am afraid.

Speak to the court involved, ask them for a copy of the case number, and ask them when the details were sent to you etc...

In particular note the points about threatening them with complains re Administration of Justice act 1970.
Threatening them with Criminal proceedings under Section 2 of The Protection from Harassment Act 1997

Also don't forget a complaint to their association.

Them having a court order without you having received any information does not sound right. Although multiple cases of mail going astray does happen.

Do they actually have the papers??

They want to play hard ball? Fine let it be so, works both ways.

Did the fine payment not appear on the credit card, and if not why was it not questioned?

So many questions....

No, didn't check my bank account at the time to see if it had gone out so my fault on that one.

Just can't believe thay are allowed to get away with this and charge such extortinate sums of cash!

I've always towed the line in terms of what i pay in my taxes etc but this type of crap makes me want to change all that and start being very creative with my taxes so I don't have to pay for civil servant scum whos jobs it is to rape people out of their money.

....and life is set to get a whole lot worse if this government passes the proposed increased powers of entry for Bailiffs into law.eek I believe they are spinning it as shout more protection for us by tightening up on the legislation and clarifying the law in the forthcoming reform ????? FFS censored

Speak to the court, ask them WTF is happening and why were you not served with any papers? Then file an N419 (IIRC) appeal on the judgment to get it stayed until such time as your Article 6(1) rights have been established by the court.
