Hi guys,

sorry that my first post here makes me out to be a TW@ but I wanted to ask a few questions discreetly.

I got stopped doing 130mph on the A14 yesterday - clear road ahead for 2 miles, no traffic, sunny, car in good nick etc and I was only doing it for about 10 - 15 secs to see what my new car could do (VW VR6).

Anyway, I now have a NIP inbound and am speaking to a solicitor this afternoon. I know it is a bit hit and miss with the JPs in terms of what I can get but I wanted to ask about some of the after effects.

I have pretty much accepted I'll get a ban with a potentially serious fine. My questions are:

If I am banned, does that make your insurance premium go up lots? Obviously thats like asking how long is a piece of string but I'm interested to see what people say.

If I had points on the license, are they wiped off after the ban? (I didn't but am not sure that I didn't get flashed a couple of days ago doing 75 in a 70)

Thanks for any input.

You might not get banned if you need your car for work. A mate of mine got caught doing 127 on a motorway and got it think 9 points and £1000 fine. He pleaded to let them keep his license as he'd learned his lesson and could not work without it.

in answer to insurance, depends on age etc. You might find you'll get a lower band car to compensate as i guess it'll get one hell of a hike!

The other question I had..

I signed the NIP in the car - I think that this was a silly thing to do seeing as I should have made them send it to me and give me the 14 days chance.

Can I ask for a repeat issue or something and say that I was panicked into signing?

As I mentioned, it is my first ever offense so I am not very Court Room savvy.

cheers

I'd assume that its going to make your insurance very high when your ban is over (assuming you will get banned)

I strongly suspect that you would have received a verbal Notice of Intended Prosecution at the time of the stop. Did you hear the words 'You will be reported for consideration of the question of prosecuting you for the offence of excess speed' or similar ?

If so, that's a verbal NIP which means there is no requirement for a paper copy to follow by post.

Best wishes all,

Been on the phone with the solicitor - reckon I am looking at a 2 month ban with a 400 fine.

Did a search and can get insurance for next year at not much more than this year! (£20 increase).

All comes down to the ban though - guess I could be looking at longer

I am an idiot.

I think your solicitor is about right.

**** happens though mate, dont worry about it. You sound like you have learnt your lesson and not likely to try it again... if thats the truth, then my guess is that the magistrates may see it that way too.

I would also go on to say that unless your solicitor is finding a loophole to fidn you not guilty, or it will be impossible to live with a ban and you are using the solicitor to aim down this route, then I would say that the solictor route may be a waste of money and may be counterproductive.

If you are going to plead guilty, be remoreful and put yourself in the lap of the gods then you would be better off representing yourself. The magistrates have to decide a suitable punishment based upon your likelihood of committing again, the offence and your financial position. If you defend yourself this does 'say something' for how genuine you are, and if you chose a solicitor to put over yoru circumstances then this also says something else, not only the fact that if you can afford a solicitor at £Xhundred a day, then you can afford a hefty fine too!

I was recently asked to 'help' my partners 18 year old younger brother who had been a right prat. From the same pull, drink driving, no insurance, driving without due care, leaving the scene of an accident and also something else which I cant remember.

I personally thought a couple of the charges were unfair and if he were to get representation might get them dropped. Instead, as he is not too academic or confident with his words, I wrote him a 'guilty speech' - the result was a 12 month ban with £200 fine. Considering that this is the mandatory minimum for DD anyway this was a bit of a result, as he could have ended up with about 20 points from just the other offences!

In conclusion, if you have done wrong, say it how it is, be honest, be remorseful - and I think you will get the best result you can get. Save the 'solicitor fees' for the insurance hike!

Usual advice.

Decent suit.
Decent shoes.
No visible tattoos.
Turn up.
Plead guilty.
Say sorry.
By your conduct show you are NOT the usual magistrate court attendee scrote.

You'll get a ban. Depends on the beak on the day how long.

It's the one where you say you are getting used to the performance of you new vehicle but unfortunately it only works if you are a police officer.....

It would seem not though, because no doubt somewhere else in the UK yesterday a member of the public got off speeding on a technicality as well.

Don't confuse the fact that because somebody is acquitted by a court that the behaviour is considered acceptable.

Exactly......except my old banger won't do 130 anyhow.

Good luck to the OP though, I hope things go as well as they can for you.

Best wishes all,
Dave.
