Fixed Penalty stuff
Discussion
I received an NIP for doing 41 in a 30 (camera) and sent it back naming myself as the driver. The conditional offer of a fixed penalty came thru, usual 60 squid/3pts with a Date of Issue 20-Feb-03. I forgot all about this til today when an enforced spring (summer ?)clean opened a few cans of worms including this.
One of the conditions for the offer is payment/submission within 28 days of the date of issue.
Just wondering which choice would be best now
1. Sit and wait to see if the Procurator Fiscal considers a prosecution ? or
2. Send off the cheque/documents anyway even tho it's outwith 28 days.
Offence on a 30mph DC, dry, midnight. Glasgow.
TIA

They is a VERY good chance they will prosecute and since you signed the original NIP then they have enough evidence upon which to convict you.
Unless you have some amazing defense to provide in court that could overturn nearly every speeding conviction ever done I would seriously take the fine.
Nb. this info is only what i have gathered from other forums and peoples court cases. i am not legally qualified in any way. maybe Madcop can work his usual wisdom on this one

Oh sorry! didnt read the post carefully enough :|
Right i see what you are saying now!
Usually they will send through a court summons within about 6 months of the date that you stopped communicating with them. I have known a couple of people down this end of the world who have got as far as you and have never heard anything again.
So good luck. Either contact them and risk them opening up the papers again or wait for the summons and if it dont come, cool

Don't bother wasting a stamp - they won't accept it. Glasgow participates in the Safety Scamera partnership, so PF in Glasgow will be in touch with an invite to Glasgow District Court. Usually takes 3-4 months, can be more.
Speed not monsterous, so probably 3, maybe 4 pp, and a fine in the order of £120 to £150, unless you declare large income or were caught in a poser's car, in which case nearer £200 - £250.
'Safety scamera' I like it..well come to think of it I don't. Thx Bob, I actually phoned them up and the ticket has gone to the PF like you say so just waiting to hear.
Same ol tunes being spun here....which I get tired of reading sometimes but now it's my turn.... prolly loads of peeps in the same boat but it's SO frustrating to get done in the dry at midnight on a DC...... coupled with a dry 85 (Vascar) on the A90. At least the camera didn't have discretionary powers but to quote the traffic geezers who pulled me 'Yes we know 85 is not much really but we've been given targets for today' and they had to tail me for 2 or 3 miles to get that they said.
Well at least we beat Celta Vigo that night.

Update on this one, I still haven't heard anything so I assume they aren't going to prosecute.
I guess it's a bit of a gamble whether or not to accept the fixed offer but if I get caught again at not much over the limit I might go down this road again even though in this case it was unintentional.
