I received a NIP last week that states I was doing 53 in a 40. They caught me with a laser gun on a dual carriage way, I noticed them but it was to late.

The NIP is incorrect as it states the wrong road junction. If it was the road junction that they stated then it was approx 500 metres from where I believe they took my speed. I have sent a letter asking to see a photo but am yet to receive anything. As the road bends around the photo would be really useful as if the photo shows the front of my car then the information on the NIP must be wrong !

What should I do ? Send the NIP back but point out their mistakes ? Any useful infomation appreciated

think you'll find that they can change the statement! bloody unfair, but in the UK a motoring offense is harder to escape than a murder rap.

I was in a similar situation not too long ago. The Policemans' witness statement refered to pointing the radar detector at a Nova, when I drive a Toyota. All the other details were correct and a lawyer advised me that it just wasn't worth fighting it. He said he defended someone once where the policeman had the direction of travel wrong in his statement. The court just accepted it as the mistake it was and he got convicted anyway.

Bear in mind that to fight it you will have to plead not guilty, and if the magistrates think you are wasting their time they may not be inclined towards leniency.

Just fill it in, don't sign it, send it back. If they take you to court you can point this error out as well as the fact that they have no confession (just don't go in the witness box).

On second thoughts, don't point it out in court. Just sit there and refuse to answer questions. Just point out they have no evidence (unless the photo obviously shows you driving then you stuffed).
