Sent an email to the M6 Toll Road helpline as follows:

Can you please confirm what the speed limit on the new M6 Toll road will be and if this new speed limit will be enforceable in current law as I was led to believe it was a private road?

I got this reply:

In response to your question I would like to advise you, that the M6Toll is a privately built road, however the motorway is designed and built to fit
into the national motorway network. It is operated, run and policed just like any other motorway and the relevant speed limits will apply. The M6Toll
will be covered by The Central Motorway Police Group.
If you have any further questions please do not hesitate to contact us.

well I guess we need hard facts about the legal status of this road.. if it's privately owned and run, by what mechanism of law can traffic regulations in force for PUBLIC roads be applied??

Shirely this scenario is identical to the new Severn Bridge?

French company comes along and offers to build a neccesary road. Government says whats in it for you, they say ooh a percentage of the tolls for the next 25 years to cover investment and turn a small profit.

Dont make it private, just privately funded...

It may be privately owned and operated, but i believe an Act of Parliament can and will incorporate it into the juridiction of plod.

Same as the roads on housing estates get incorporated into the juridiction of the local council when they have been inspected and met the required standard.

Feel free to shoot me down in flames if im wrong though.

I've seen the term 'unadopted road' before, either on street maps, or an actual road sign, i think the last time was on an industrial estate somewhere

Regarding privately-built roads: does anyone know how a private company is able to get hold of the land to build the road in the first place?

Usually, to build a road, compulsory purchase orders have to be issued (to get hold of land and knock down houses for example) - I thought that only the government (the secretary of state) could issue compulsory purchase orders - perhaps they still do, but on behalf of a private company. Hmmmm....

Its by the age old process know throughout the government as "back handers" and "bent"
