Parking querry
Discussion
At work - our office block has its own parking spaces - as has all others, but it's obvious that for private cars and works vehicles there aren't enough spaces, so any unused spaces have been used. Looks like parking area is part of the complex, and as such private ground. With parking at a premium, landlord has indicated that vehicles parked in wrong spaces will be clamped, although no signs up for this. Seem to remember that signs are needed to allow clamping on private ground ?????????????????Any guidance??
Courtesy of CAB:
If you park on private land without the owner's permission, they can legally clamp your vehicle. However, they can only do this under certain conditions.
Your vehicle might be clamped on private land when:
• you have parked in the car park of a block of flats, where you are not a resident
• you have parked in a car park reserved for employees of a company, when you are not an employee
• you have failed to display a ticket or permit properly, or at all
In order for your vehicle to be legally clamped:
• there must be notices up where you can clearly see them, warning that unauthorized vehicles will be clamped
• the landowner does not charge more than a reasonable fee to release your vehicle
• your vehicle is released as soon as you have said you will pay the release fee
• there is a way for you to get in touch with the landowner (or their agent) to make arrangements to pay, for example a telephone number on the warning notice.
Your vehicle must not be clamped if:
• it displays a valid disabled badge
• is a marked emergency service vehicle attending an emergency.
Person running the clamping and their employees have to be licensed under Securrity Industry.

who me said:
Sorry to be a pain -DVD - just re read the last bit about "legally clamped " --now what if some /all of the conditions are not met - who regulates / polices the legality of the situation/
Depends.
Certain aspects are criminal offences by those clamping, in which case it's the Police.
Other aspects are civil & you'd have to sue.
