Hi,

Is 101mph on the M6 on a quiet morning an instant ban?

Thanks

No. It'll take them a few months to get round to banning you.

Well give us something to go on, rather than just setting up the one-liners.

How were you caught?
- remote enforcement?
- stopped by plod?

Were you offered a FPN, or has it gone to summons?

Were there any other aggravating circs - for example are you on bail?
Are you at risk of a totting ban?

The mags will consider a whole range of things, together with any special plea you may make regarding exceptional hardship if banned. Most appeals for exceptional hardship are noted very carefully (you can't use them again for several years), checked thoroughly, and by-and-large accepted if genuine.

Was driving back from scotland and got caught just past kendal, unmarked omega.
Gave me a producer and handed it in at my local station. 1 month ago

You're borderline. It's hard to say without more facts, and in particular the officer's statement could make a difference. And of course what the chairman had for breakfast.

I'd expect 6pts or a short ban of a few weeks and a fine of two week's wages + costs. Ought to be able to avoid the ban with early guilty plea, evidence of contrition and some evidence of exceptional hardship if banned.

What a waste of resources enforcing stupidly low limits on clear roads is.

Not in my name.

From recent cases I would say 30% chance of short ban, 70% chance of 6 points and £300 fine.

How much of a tw** you are in court and how much the magistrates empathise with you is the major swaying factor.

If you have a clean licence this goes in your favour, and if of course you can put forward you made a one off silly mistake, then 6 points is the more likely outcome.

Cumbrian justice (IMHO) seems to be dealt with a big heavy stick!!!. Be prepared for the worst.....anything less and your on to a winner.

Oh yes, Cumbria. Expect to be hit with a big stick, it's to save lives you know.

In their latest campaign to "save lives" they've decided to "create uncertainty" in drivers minds, this will of course make people much better drivers.

You couldn't make it up.

Nor mine. What a waste of everybody's time, pissing about with trifling speeding offences - which ought not to be offences to start with! mad

Good grief - 101 mph on a quiet motorway. So what?

Best wishes all,
Dave.

As you know - the offence is "failing to spot enforcement".

Do you know if they used VASCAR and if so, did they show you a video?
If not, write to the court and request a Newton Hearing, pleading guilty to exceeding the speed limit, but that your speed was nothing like 101MPH.
They will then have to offer evidence to the contrary and if they had an unmarked Omega it would certainly have had video equipment.
If they have deleted the tape, which is often the case, they have destroyed the evidence of your specific speed; you can use that fact in your defence.

Assuming for the moment you don't turn to stone in sunlight...
Smart is good. Show respect.

If you were thinking of turning up in full Sparco Nomex racing suit, with helmet tucked under arm, then that probably sends the wrong signal.
