In-correct mileage!
Discussion
Hi all,
Having just purchased a mk2 Mazda MX5 import from a garage ive discoverd that the electronic odo is reading in miles and not the kilometers as stated and advertised!! The car was advertised as having done 62K miles and the guy at the garage assured me the odo showed kilometers ie ~100K. Now after checking out a few known mileage routes the odo is recording miles and not Km, ie the car has an extra 40K miles on than i thought!
Where do i stand legally?? Im fairly happy with the car as it is, can i claim some money back to compensate for the additional mileage??
Thanks
Andy

If he definitely said miles and there was no "buyer beware" sort of sticker on the speedo then maybe you could get some money back, after all it's done nearly twice as much as advertised! Was is described in writing anywhere as having done 62k miles?
Easy
The goods were not as described.
Do you have a copy of the advert?
The dealer was capable of checking and establishing the facts before placing the advertisement.
The dealer has a duty of care to ensure that all advertisements are accurate.
Work out the difference in value given he extra mileage assumint that there would be a difference and talk to trading standards and citizens advice.

Regardless of "caveat emptor" (buyer beware) if the guy has said it's done 100k km, and it's 100k miles then that's naughty.
First thing I would do is go back and ask the chap to explain the discrepancy between what's been said and the truth.
Secondly I'd ask what arrangement he thinks you two can come to.
Thirdly, if his suggestion doesn't match what recompense you would like, return the car - it's not been sold as described. Other important legislation would be the Trade Descriptions Act (1968), binding dealers to describe cars accurately; which this one seemingly has not.

I might be being very dim here, but it could be kosher-ish.
If the speedo had reached 100K KM before being imported, and they then SVA'd it, changing the clock to record in miles, then Shirley it would start recording miles where the other one left off.
If he has misrepresented the mileage however then you have a case regardless of the weasel words on the invoice.

The car was imported and registered in the uk in june 1998 so i assume that most of the 'mileage' has been done after the initial conversion when it arrived in the uk?
