Hi - a friend from work managed to be caught speeding on the way to the bank, then again on the way back (same road, about 50 minutes apart). 50mph limit - NIPs came for 60mph & 64mph - they want 2 x £60 and 2 x 3 points.

Is there any point asking for this to be treated as 1 offence, or is it just a case of paying up.

FYI - forward facing camera & talivan so no use of loophole available.

Thanks for any help,
Dave

he does not have to pay both of these. It can be argues (definitely) that as it was impossible to inform him of offence 1, before committing offence 2 he cannot be done (or something).

Definitely worth fighting this one....have sat in on a case where a guy had driven his astramax ferraroghini from somewhere in Cornwall to London and got 17 tickets from fixed cameras in the space of one day. He was only done for one offence.

Im sure someone will enlighten you (and me0 as to the exact way of doing this!

Makes no odds mate, send them back and without signing them and the chance of plod following it up is slim to none.

Paul over at SafeSpeed has looked for cases where a speeding offence has been successfully prosecuted based on video evidence alone and found precisely none.

definitely legal precedent for asking it to be treated as one offence but you will have to appear before the beak I'm afraid.

Be prepared, if your plea is successful, to get 2 fines but only one set of points which is probably the key issue perchance?

Think the points are a problem rather than the fine - I think 6 points would make a significant difference to insurance premiums, when 3 would only be a little extra - for the next 5 years

They'll be his first points too.

I go with Fastshow on this and send them both back unsigned. That way he should end up with no fines and no points.

Don't sign, good idea.

Only if the cameras were in the same direction would you get them all lumped into one "crime". Having to turn round and drive back means you're slowed down, picked up speed, and are now committing a 2nd offence. Unlucky mate, but best of luck.

I think i read about a case where a guy got caught on the way to and on the way back from somewhere (same as in this case) he argued that the fine/points are meant to act as a deterrant and he would not have had chance to receive the first FPN and adjust his behaviour accordingly.

i think he was only done once as a result.

years ago (approx 1994) peter beardsley got done on a stretch of road up here (beresford road in seaton sluice if anyone knows it) once going & once coming back - same scamera. He was done twice for those moments of inattention.

i have always been under the impression apealing against speeding fines was a very tricky area as can't they quite easily make an example out of you and whack on a maximum fine.

thanks guys - it was me who got the fines! I'm not sure now -I think I'll sign and take my punishment. I'm in North Wales, and so were the offences - and I hear they are looking for as many convictions as possible, and so to do anything to stop me getting all 6 points would probably result in far more serious problems! I wil lsee if they will be leniant, as I will say I never had a chance to change my behaviour after my first offence, before receiving 2nd - stupid thing is, its the first time I went over the limit on this road!
