  1. # I've also posted this in the Pie & Piston forum!!! ###
I'm stuck?......my 9 year old son has resided in New York, with his mother, for the past 2 years, when she took up a temporary contract (2yrs) at her employers world wide head office in New York.

I fought this through the UK court system but the judge found in favour of the mother; mentioning that her right to a career comes before the fathers regular parental access to my son (before he would come to stay with me every other weekend; friday-monday). A temporary 2 year removal of him from the juristiction was granted.

Two years down the line (I only see him in school holidays!) she's now seeking permanent removal due to the fact that she's been offered a full time position at the company in the US...as the office where she was sited in the UK has now closed; and the staff moved to other offices in the UK. She's had more than a year to look for alternative employment over here!

My question is to any UK legal buffs out there(???)...when her legal team presented the application to court 2 years ago it was on the understanding that the trip was for a fixed two year period and that the judgement also stated that to be the case. Do I have any chance of stopping her in this instance????

I feel for you. Aint got a clue about the legalities, but as a guess, I would reckon she can do whatever she wants.

Just hope you get to see him as often as possible.
