Yet another one I apologise.

I post on here a fortnight or so ago, asking about a scammera in stockport.

Well anyway the FPN has come through to the woman that deals with the company cars and she has duly been in contact with myself.

The camera in question is definatly a rear facing one but the FPN says it has a frontal picture, why would it say this?

Also, with the verdict coming out on the 29th would it be worth holding out till this date before incriminating myself?

If i request a copy of the picture would that mean that i wouldnt have to incriminate myself untill the picture comes through?

thanks in advance for any help...

Could you have been reversing at high speed at the time the device was triggered?

If you haven't received a Notice of Intended Prosecution (ie addressed to you), then you are under no obligation to do anything at this time..

Responding to the company NIP is the responsibility of the Company Secretary / Fleet Administrator / any other duly authorised person, but not you..wink

If you do get to receive your own personalised NIP, then this will be after the ECtHR judgment of 29.06.2007 and everyone should have a better idea of how the land lies..

Illegal to reverse for longer than necessary and certainly not at speed.

I would be very tempted to call their bluff on this one!

I guess it says this to stop people, quite correctly I might add, thinking that with a rear facing camera it is impossible to prove who is driving without an admission.

When I was cornered, I would ask them for the front facing photo they have quoted exists!

This was my thinking as well. Looking at pepipoo(sp?) it says do nothing until the NIP addressed to me comes through the door then send back a PACE statement.

Has anyone gone down this route before?

Courts love PACE statements. It means they don't need to feel bad about taking away people's licences and adding the victim surcharge.
