Three friend of mine traveling through our local town, 2 in front 1 in rear, the one in the rear was sitting in the middle with seat belt on, when trafpol pulls them, apparently law say you cant sit in middle if you are the only one in the back. Ok if so, it needs to be advertised a bit more as every one i have spoken to has never heard of it.
However the point is that plod didn't inform this 19 yr old girl of this law no, he has given her a time to attend the police station where she will be charged.furious
nice one, 3 more people on cop side

Charged for not wearing a seatbelt????? hard to believe? whats wrong with a ticket?

Anyway a major point in english law is that everyone is assumed to know the law once it was made. If your not sure then its up to you to find out!

WTF!?!

She was wearing a belt but has been charged because she was sat in the middle seat???

Seriously, is this a p-take? I've never heard anything so stupid in all my life! So long as the car can take 3 rear seat passengers, I see no problem with a sole passenger in the rear opting for the "bitch-seat".

Charged for not sitting in the correct rear seat?

Is there a law stating what seat someone must sit in?

Why, oh why would anyone get charged for that???

Was the middle belt a lap only, or lap and diagonal? - Streaky

Never heard of that one before........

Would be interested to learn Act and Section contravened.

There is an offence of carrying a passenger in such a manner as likely to cause danger....?

Sitting on a properly fitted seat, wearing a lap strap at least? Can't see that one flying.

I've never heard of such an offence either. Are you sure this story is correct?

Even if it was an offence it would be an FPN to the passenger concerned at the time.
Seems an odd story to me.

I can't see this either, in fact Miss FiF sometimes sits in middle seat albeit with 3 point belt fastened.

Ready to stand corrected but this reeks of the person in the back not having a belt on, but claiming they had a lap belt on when collared?!

Like I say, would love to read in the Daily Mail that this did happen as described, but somehow doubt I will. wink

I cant think of anything that would be dealt with by charge here. FPN maybe but charge no.

Sounds like someones not telling the correct story here!
