My wife's altercation with a Seat in the supermarket I asked about before, but just to clarify:

If it's deemed 50:50 and she doesn't bother claiming for her (optional) repairs, her insurance hasn't paid out so no loss of NCB right?

The insco seemed to be saying she might as well claim as she'll lose NCB anyhow, but that seems wrong to me as they won't have paid a penny out. (his insco pays for his repairs)

What's the law?

If it is deemed 50:50, then the other side's insurer is entitled to recover 50% of their outlay. On that basis, your wife's NCB is affected.

I see, thanks. So she'll only pay half of her excess then?

She will pay the full excess, but can claim back 50% of the excess from the other side's insurer.

Super. Thanks... Of course it's too much to expect for her insco to add half the excess to their claim to save her the trouble.
