just going through a very tedious and long winded insurance claim at the moment, a friend borrowed my motorcycle and unfortunatly wrote it off by someone pulling out and doing a u turn in the road without seeing him, he hit the car in the side, the other party is trying to deny liability by saying he was riding dangerously and recklessly which he wasnt, but my main question was, they said thier waiting on a police report but my frien has had a letter several weeks ago saying the police are taking no action against him which obviously implies that he wasnt doing anything wrong?, plus this accident happened at the end of febuary, would it take 4 months plus for the police report to be made available to the insurance companies involved?.

So the car driver had a long enough view of your friend to see him and assess his riding to be dangerous and then still decided to pull out in front of him?

'kin moron!

Insurance claims like this can take months to sort out and settle. It could take upto 12 months to get it all sorted and paid out.Keep putting pressure on the other parties insurance company.

Insurance companies can pay for a police accident report and ascertain what the police view of the cause was.

They are not waiting to see the Police Report to see if any action is to be taken against your friend. They're waiting to see it, because it is possibly the only piece of independent evidence as to what happened, and why. It well help them to decide who is likely to succeed, or not, if the insurance claim went to court. Requests for Police Reports invariably take a long time to come through from Police Admin, several months is commonplace.

Following an RTA that Police deal with and FULLY record then there is a procedure for the Insurance Company, on payment of fee, to obtain an abstract of the information from the Police report.

Regretably there are instances where a delay can occur plus the inevitable when paperwork is flying around various offices.

As advised keep pestering...

its in the process of going to court at the moment, what i do find interesting though is the other parties insurance company has already made my friend an offer for his personal injury without even seeing a doctor, which doesnt seem very common?.
the other party has written to me directly requesting that i drop the claim, and if i dont they will issue a counter claim against me for 'distress and inconvienience' plus thier insurance excess, my solicitors said that they cant make such a claim as i wasnt the cause of the accident nor was i even there, so they would have to attempt to issue against my friend directly, it was my solicitors feeling that they were 'trying it on' for lack of a profesional phrase.

To me, a request to drop the claim and subsequent threats makes me think they know they were in the wrong.

it gets worse than that, they were doing a u turn without looking, from what he says just pulled out and he hit the car in the side an he went flying down the road, its lucky he wasnt speeding, if he had been doing 60 and not 30 i think he wouldnt be here today, judging by the seriousness of the injuries he had after.

I would pass on these threats to your insurance company. The other party appear to be taking the urine.

He already has done; i.e. he has already spoken to his solicitors, whom his insurer probably referred him to.
