Why does HMRC seems to treat us differently than non home based businesses?

I would have thought we are the greenest businesses as we have no commute, and we support local communities (some months we are 10% of the postage sales at our post office)

Yet, there can never be a pool car , any gym equipment for staff is disallowed and every £ of spend on the premises gets scrutinised as not 'wholly and exclusively'. CT has been raised for small businesses

Needs a rethink by GB I think.

Worth a letter to the local MP?

No; unless you live in Cowdenbeath.

The trouble with "pool" cars and home based businesses is that the definitions of a "pool" car are so tight that just the mere fact that such a car is parked on the home drive precludes it from being defined as "pool" car.

In reality, many businesses with genuine office premises cannot legally claim for pool vehicles either.

Regarding gym equipment - if the company had bona fide "business" gym equipment and was therefore able to claim Capital Allowances on this equipment, would not the use of the equipment by staff and directors constitute a "Benefit in Kind"?

I looked at the gym thing Eric, it is specifically a BiK at a domestic address but is OK at a business address withiout any BiK. HMRC have a specific bit on their web site about it.

I was thinking back to my corporate days when staff were taken all expenses paid on the 'annual sales conference' in either Prague or the Carribean, the 'team building days' out carting or at Goodwood and the 'away days' at swanky hotels with great golf courses to 'consider corporate strategy'.

HMRC would eat me alive if I tried that.

I suspect that if they were more flexible, then many people would abuse it and pretend they have a home business to save paying taxes elsewhere. Such is life!
