I have searched on Pepipoo and cant find this exact problem or an answer so hence the post.

No PCN (single yellow) ever applied. Just round the corner from our flat and did stop on a single yellow to take a phone call. For all of 30 seconds!

4/5 weeks (I think) later, Notice to owner etc. I reply, furiously, that no contravention occurred and no PCN ever issued to me or the car. (I did not drive away etc)

My appeal against PCN has been rejected on the grounds that the attendant actually handed me the PCN. I guess this explains why no digi piccy of ticket on windscreen then? LYING CHEATING B4STARDS. NB I was not handed any PCN.

No warden/attendant/thief in view. No PCN ever issued etc etc. Livid! Refuse to roll over and pay these scum £50. The personal hearing would take place 200 yds (well very short cab) from my office in London. F**K 'em. Going for costs and a vexatious waste of my time.

What are my chances and any ideas etc etc? Just dont have the sense to pay these scum the money. Sorry!

ps - I normally park in one of these streets in a residents bay so not hard to get or record the details off tax disc etc.

Go and look and see if there's any CCTV cameras. Take a photo of them. Suggest that if they were telling the truth they'd have the evidence in court. Request the footage of CCTV owners in writing and present copies of letters of refusal. Suggest to parking people that if they have evidence they should show it.

Presume that after your submission to LA they rejected your submission and sent you form ' Notice of rejection of representation" This should have been accompanied by a NPAS (Adjudication) Notice of Appeal Form for you to take the matter, should you so wish, to the Parking Adjudicator which should be submitted within 28 days of receipt.
NPAS will then acknowledge and give further information.

Just check the PCN to ensure that there is two dates on it - date of issue, date of offence. This is required under Sect 66 RTA 1991 and confirmed in Moses v Barnett Council [2003]. There jhave been a number of Councils taken to task over this making the PCN illegal.

DVD,
Will check on your point re the dates. I have the 'Right to appeal' stuff sitting here on my desk. Just didnt want to fire it off strapped to a ICBM if there was/is an easier way to deal with it.
