Just recieved a NIP through the post, 52mph in a 40 zone, Manned Camera (guessing LTI 20-20)

I remember the incident quite clearly, as I was speeding up to move out of the way of an ambulance coming from behind at speed, so moved over.

I'm requesting the photographic evidence of it to see if the ambulance is in shot, they did have the flashy lights on and sirens blaring, so if this is in the photo, reckon its worth contesting??

Someone mentioned to me though about a guy who went through a red light about 10 foot to make way for a fire engine and he got 3 points for it, appealed and did not win his case.

Worth a try,but strictly you do not have any exemption. If this were a sensible country though, no doubt the operator wouldn't have pinged you!

If only...

End of the day, whats more important... Moving out of the way to let a paramedic response vehicle get to where its going, potentially saving someones life, or £60 to go in the giant government money pot...

My faith in this country, in fairness from my own experiences dealing with the police on various occasions, is dwindling...

If the facts are as you say a copy of the picture should clear it up, and a copy of the video almost undoubtedly will clear it up!

Its not just 60squid though is it. The insurance hike, and more importantly, the 3 points.

If you do contest it surely the prosecution is going to ask why you needed to speed up to move out of the way of the ambulance, could you not have left enough room by simply pulling over towards or onto the kerb?

Don't bother, a perfectly safe decision and a perfectly sensible one in any normal country doesn't count for squat when there is another punter to be had. In the not so great britain of new labia you are supposed to hold up vital life saving missions.

To get to a safe place to pull over.

If this story is true (and I'm betting it is), the video will show it and will show the little flurry of bonus stings the scum behind the camera managed to collect as people properly moved safely out of the path of the ambulance.

It should be played from the roof tops to demonstrate how these imbeciles operate and used to further the decline of their parasitic antics.

My guesstimate is that if you have the guts to push this case you have a 90% chance or more of getting a good result.

If what you say is true and there is an ambulance behind you then when you request the video evidence - which is the logical way forward before trial - then that video will be gold-dust in the hand of any journalist as it now shows the operator looking to make money out of someone being public spirited. An automated camera doesnt have that opportunity but a human can!

My guess is that the CPS will drop the case like a hot potato as soon as they realise that what you are saying is true. Technically you are guilty - if the device is correct. Speeding is an absolute offence, no ifs no buts.

However, magistrates are not legally trained and a lot of them let common sense overide other issues - there is a good chance that this will be the case. There is also the factor that you can be found guilty, but given zero punishment, no points, no fine - as that is what they deem fair in the circumstances.

In any case, the time is ticking to question the FPN and I would get going now!

Sadly, chances of getting the video are slim to nil (just look at Peter Ward's thread(s).

I would definitely consider speaking to somebody about it - but the unfortunate fact is that, as a member of the public, you and I are not allowed to use discretion. What you should have done was either stop, in a dangerous place, forcing the ambulance to make a dangerous overtake, or continued at the speed limit (or less) to a safe stopping place - as the trained ambulance driver would be able to pass you eventually anyway.

Obviously the ambulance driver would almost certainly prefer you to put your toe down a little, get out of the way - and be on his way AFAFP.

Hard lines, and good luck if you decide to fight it.

You should be able to get the bit of video pertaining to you I think? In which case the ambulance should be on it if the OP's version is correct.

Have you firstly checked all the obvious things such as date of issue etc etc? Always worth checking to see if there is an easy get out such as them issueing it late.

If I was stuck behind a red light that had a camera and blue flashing lights came up behind me then sad to say they would be going nowhere until the lights changed!

Unlike in PW's case here that video will be relevant. In Peters case it is about not giving info as its not needed about other offending vehicles. In this the OP will have direct evidence in relation to his (the ambulance).

A well written letter may see this dropped before court. I would allow some leway if I was satisfied it was necessary and not excessive. For example if it was more than possible to pull over or if chappie goes up to quite a high speed thats no needed I may be less willing but in most cases as long as I was satisfied then I would not act.

Only last night 3 cars moved through red lights to allow me to pass and none of them have got tickets.

What if there'd been a red light camera?

Absolutely - the message from the Government and BiB etc is that if you are at a traffic light, it's red, an amulance is behind you blaring lights and sirens, and it's trying to get to a major accident that you can see a couple of hundred yards ahead, with wrecked vehicles and human limbs everywhere - you ABSOLUTELY MUST NOT MOVE UNTIL THE LIGHTS TURN GREEN.

That's the way the Government want it (that some people strangely voted for, on more than one occasion 'cos things were so good, and continue to support).

That's the way I see it, and that's the way I'll act, as I don't want any more tickets for crimes like getting out of the way of a police car. If they want my car to move, they can damn well move it themselves!

Why doesn't the OP find out the call that the ambulance was on, and even find out who was driving - they may well remember you getting out of their way (plenty of people won't have done) and they may back you up.

Couldn't you claim an exemption as you were aiding an emergency vehicle (ie as if you had someone critically ill in your car)...
