I know the car is a bit dirty..... is there a sensor that turns the lights on and off that I could clean?

I thought mine wouldn't switch off on my 130i but I'd actually managed to turn the daytime running lights on via the onboard computer and didn't realise (when bored sat in traffic). I've no idea if it's possible to do this on the 330Ci but might be worth a look before the embarrassing response from the dealer.

I was the same ... turned mine off via the iDrive but I only found out by accident that this was possible.

hmmm, I wonder!

I have a mk4 (non-idrive) system but have a carPC linked in. It uses the satnav screen and buttons.

It may have set something but Ive never seen a menu item to do it
cheers
Tony

I take it it's an E46 then. The light sensor is integrated into the rain sensor so if thats dirty/delaminating from the screen than it may be the cause. Has the car always done this since you've owned it? If so then it may have daytime driving lights activated in Car/Key memory - which will need to be changed by a dealer.
Don't bother looking for settings in the Car the E46 didn't have the so called 'Personal Profile' that the E8/9X models have.

A scratched screen in front of the sensor will also affect it
