Fault code 0339 Intermittent Crankshaft sensor

Hi All, first post, hope I can help some of you out in the future but I am stuck with a problem at the moment, I did post this on the roadfly forum before I found you guys.
I have a 2001 325i auto, the other day the car jolted and Check Engine light came on, the car still drove but was very sluggish and is now takes a while to start.
On checking the fault codes with a reader it said code 0339,
Crankshaft Position Sensor Circuit. Intermittent. cleared the codes and restarted the car, and again the same fault code was there.
Got it up on the ramps and took out the Crank sensor and it looked a little worse for wear, had started to crack so I had no reason to doubt this was the problem, ordered new one from stealer the dealer at a cost of £65.00 ($130) put it in and same problem.
Took it to a landrover dealer friend and he put it on his full diagnostics machine and got same fault, so has anyone had this same problem, any ideas of a solution.
Called up the dealer to ask for a replacemant sensor as I believe this one is faulty, and they said that I would have to buy a replacment and have the old one sent away for testing and if found faulty I would then get a refund sometime in the future.
Just traced the wires upto the DME and put a scope on the CPS wiring to it, the Thing is working and have a nice 5 volt square wave, but there is a regular interuption to the signal, as if somthing is interfering with it.
As the wiring goes direct from the CPS to the DME then I'm assuming the fault is going to lie with the DME.
Any ideas anyone ??
