My friend has been very naughty
Discussion
She said that 2 BiBs came around her house, cautioned her and then said you were going too fast when you came off motorway. You then were going 95 in a 40 and then didn't slow down and were doing faster in a 70. They asked if she had seen them chasing her (answer no).
Thing is she had parked walked home and they came knocking.
They gave her a option of dangerous driving or 95 in 40 and then said but in fairness we'll give you a fixed penalty £60 fine on a ticket for 90 in a 70...... which she accepted.
Is any of this actually legal?

I can't undstand why anyone would think any of it is at all illegal? (assuming you mean Plod's actions? Not the speeding which is obviously illegal).
I'd say she's been very luck to get done for the 90 in a 70 bit, especially if she really had been going so fast in the 40 zone

If they had the blue flashy lights on I'd be more inclined to think 'why the hell did she not see them?'
However much you like a bit of speed (and god knows I do) it can't be safe to do 95 in a 40 if you're too myopic to see blue lights flashing behind you, whilst being 'chased'
FFS she should count her self lucky!
A mates Mum did exactly that years ago and my blood boiled as they just let her off. Followed her all the way home with blue lights and flashing headlights. She just pulls up on her drive, gives it the 'oh sorry didn;' see you' and they let her off.
If not looking at what is happening around you is not dangerous driving, then what the hell is????
Grrrr.

Well that seals it - I'll tell her to pay the fine and accept the points like a man...
For the record - the 40 speed limit is on a dual carraige way - I am reliably informed that actually no-one can drive this slowly on this piece of road - 60 would be a sensible marking but then everyone would be going nuts down there.
When asked if she saw them, she said she was concentrating on her driving - they agreed that doing this speed - that as likely - apparently she was hoofing it and they were a fair bit behind by their own admission.
Thanks for the info.

I've no problem with the fact she was doing X in a 40, 50 or 70, I really havn't and good luck to her. I just have a personal bug bear for people who don't see the most obvious things when driving (at any speed)...like police cars.
I am of course making a huge assumtion that they had their lights on, but you said 'chasing', so I guessed they had. If they followed at a distance in an unmarked car and didn't try and stop her, then fair play, rant taken back...

Did she do it? 95 in a 40? If so getting away with £60 and 3 points is a BARGAIN.
I wouldnt have said it was ilegial. However if this goes to court the BIB wll have a pretty hard job of proving that she was in the car at the time of the said offence if no video evidence was available and would more than likely be thrown out due to technicalitys.

Might I suggest adding a "t" to one of the words
That always fools the "they ist always pedant spelling police brigade innit mate!" or whatever the Ali bloke say innit
Now even I do not understand what I just wrote

But apart from most facetious "senior moment"
- - it C OA S T - which mean look in the bloomin' mirrors und observe lollies
So
I agrees with you Liebchen

But sometimes this for reason -planned retail/business park/housing estate. C O A S T mean observing all hazards 8nd potential scam areas. Safer it ist.. most unreasonable the speed limit.. the greater the chance of hidden scammer.

.I accept some are sheer money making exercises but the odd one has reasonable logic behind it

I think perhaps "she" has form Thanks for the info.
But no matter
. She one lucky person to get the offer. I do think family BiB as I know them.. their "discretion" would be skating on wafer thin ice here
per the odd thing they let slip
I got done in similar circumstances about 10 years ago, the plods were up on a slip road on the M1. As an advanced motorist I check my mirrors all the time, but still missed them until too late.
As to getting off on a technicality - too late mate. She admitted that she was driving the moment that she said that she hadn't seen them in her mirror. Her own "verbals" would be used in court against her.
As soon as she took the fixed penalty she admitted all the liability needed.
If you want to challenge stuff in court - stay schtum with the plods at the time and make them do all the work, then they make mistakes (like any other person).
Take the lumps and avoid the courts it's much cheaper when you know you are in the wrong.
