Bugger!!
Got my second ever parking ticket last week. Overstayed my welcome at an on street parking bay. The thing is the ticket describes my car a 'colour Black'. It is actually Green. So for the sake of £30 should I pay up or do a Clarkson and try to get off on a technicality?
Do it properly. Got my second ever parking ticket last week. Overstayed my welcome at an on street parking bay. The thing is the ticket describes my car a 'colour Black'. It is actually Green. So for the sake of £30 should I pay up or do a Clarkson and try to get off on a technicality?
Have the car resprayed in white.
Change your name.
Have a gender reassignment.
With a bit of luck you will save £30.
If you do not accept by paying then LA will send a Notice to Owner which is the start of the appeals process.
Schedule 6 RTA 1991 A notice to owner MUST state—
(a) the amount of the penalty charge payable;
(b) the grounds on which the parking attendant who issued the penalty charge notice believed that a penalty charge was payable with respect to the vehicle;
(c) that the penalty charge must be paid before the end of the period of 28 days beginning with the date on which the notice to owner is served;
(d) that failure to pay the penalty charge may lead to an increased charge being payable;
(e) the amount of that increased charge;
(f) that the person on whom the notice is served (“the recipient”
may be entitled to make representations under paragraph 2 below; and
(g) the effect of paragraph 5 below.
Nowhere is listed that the colour is essential feature but the vehicle must identified (b) - which is by VRM and make.
IMHO get the wallet out and pay early at the reduced rate as I cannot see you winning with just the colour wrong.

Are the bay markings correct?

If they're not, then the bay is unenforceable, and I wouldn't pay.

No don't pay it.
They have got the description wrong and thus cannot prove it was your vehicle.
Never paid a parking ticket yet, just another fecking tax as far as i am concerned.
I got a letter through the post last year from some company claiming my car was parked illegally at some motorway sevices, and i had 14 days to pay the £80 fine!!
I wrote to them asked to prove it through CCTV or other evidence and of cause they couldn't, so polightly told them to f@ck off and have heard nothing since. No what ever you do don't pay it, challenge the system.
