A quick question for you (I hope you know the answer).

I have mistakenly paid a contractor a fair bit of money and deducted the appropriate amount of tax etc.
Said contractor has delightedly recieved mistaken money and will never be seen or heard from again i.e. there is no hope of reclaiming the money.
Can I reclaim the tax deducted as the whole payment was a mistake?
I wouldn't normally bother but even the tax is a considerable amount frown

With due respect to Eric have you not asked your accountant what he thinks? Not being rude but just wondering confused

There are probably 20 people I could ask. Just too busy for a long conversation in office hours and I have more faith in what Eric Mc would have to say than most scources (including a random call to the Inland Revenue)

If this was via a BACs payment couldnt this be recalled within 7 days??? My employers have done this to me once and left me up shit creek without a pladdle..

Sorry for not replying earlier. I've been out of the office all day.

Why don't you think that you will not be able to recover the money paid in error to this individual?
It is a criminal offence for him to keep it as it is tantamount to theft.
I would formally notify him of the error and advise him of the manner in which you intend to recover it. If he pleads poverty you might be magnanimous and recover it in monthly installments - but you should not assume that you cannot get it back from him.

If he refuses to co-operate, threaten legal proceedings.
