I heard this story third hand…is it plausible?

A family member was caught drink driving 2 weeks ago and has since appeared in court to receive 10 points. He had already resigned from his job before the court appearance, but after getting caught. I don’t know whether he mentioned this in court (or the fact that he’s an alcoholic).

I find it astonishing that he didn’t get a ban.

ETA his job (the one he resigned from) required him to drive.

I think the courts can take into account exceptional circumstances where they do not have to ban. I can't think of any cases to hand, though. I would have imagined they'd put 12 points on if they were going to do that, anyway.

not an instant ban if your a high ranking MALE officer in the police force, working in the northwest of england, for example.

however, if you are a FEMALE officer of the same and or similiar rank, it would appear to be different.

It sounds like he may have been convicted of being in charge of a vehicle whilst unfit or with excess alcohol, as opposed to driving with excess alcohol..

I'd have thought he would've got an instant ban, if they're going to give him 10 points they might as well make it 12 and ban him. Personally nothing hurts these rodney's more than a massive dent to the wallet. If people knew they would get, say, a £500 fine for drink driving regardless of how far over the limit they are, they would think twice about doing it. Oh and I'd still ban them.

I would say that this is most likely the case.

Although it IS possible to escape a ban, without knowing anything else about the case, I can say that probability sways heavily towards the above.

One of the signs of addiction to a substance is denial it causes you problems and lying to be able to continue you uninterupted supply.

Thanks for the replies so far.

Is there a way for me to confirm the penalty imposed by the court?

Court records are in the public domain, unless it's a Family Court where they can steal your children, then it's all very secret!
