I have this house that had a wall running down the entire length of the garden for about 80 feet, over the past few years the neighnour has been asking me if she could knock it down and replace it with a fence. I said no as I looked at my deeds and it's my wall, her only reason for not liking it is because it doesn't fit in with the feel of her garden (her words)

I don't live in this house but went to visit it today to find the wall has gone and a 6 foot fence is in it's place.

Where do I stand, can I get her to rebuild it?

Wouldn't that be classed as vandalism or something like?

I'm worried she will say it fell down or something not that it would without the assistance of a JCB

Even if it did, it's not her place to replace it - that's both your job and your responsibility. She knows who you are and how to contact you (from previous contact) so there's no excuse.

Get a solicitor on it and get her to rebuild as was.

Why couldn't she put up the fence on her side of the wall (and on her property) to screen off the wall if she didn't like the look of it?

God knows, she's the sort who puts notices on cars to not park in front of her house despite it being a public road.

She's obviously waited until I moved out and probably thought I was selling it.

Solicitor for sure, oh yes

Rest assured knowing the silly bint has probably spent a LOT of money to knock down an 80ft wall and build an 80ft fence. Now she has to spend even more to put it right!!

Oh yes. And keep us updated. Assuming all is as you say it is, she's in for an interesting time...

Is her name 'Bouquet' by any chance....

She ahs replaced a solid wall whoch would probably last 50 years with a fence that will probably last 8 years. I'd be livid, and she would be hearing from both my solicitor and the police.

Quite, would have been really easy.

What she has done is criminal damage - call the police and at least get a crime number.

If the fence is now in the same place as the wall was, it's quite possible that it's actually on your land.

If it was your wall, it's still your fence. Get it on ebaysmile

Apparently, the council can enforce garden boundary issues. Is she on your left side? I was told that usually, you are responsible for the boundary on your left (from the street), and if the neighbour replaces it, they can be forced by the council to put it back as it was...

Make sure that you have pictures of how it used to look to prove that it was not ready to fall down.

Also ensure that it is built back to the same standard. Hopefully the police and solicitors will be very helpful and make sure that you keep us updated.

I take it you are renting the property out now, if so ask your tenants if they tried to contact them and if not they can also provide statements. But ensure they know what you are doing so they do not interfere with your case.

All the best
