Is this now officially illegal?

Just read an article in the paper about confused.com claiming insurance companies will up premiums if caught doing this ('under the new rules'confused) and some will refuse insurance for 2 convictions.

How did that one get sneaked through? There was practically zero publicity and if it is now banned there must be loads of people driving around smoking in their own cars in total ignorance.

It's not banned. My understanding is that it's been decided it can equate to driving without due care and attention if smoking causes you to drive dangerously or cause an accident. Eg lighting a cigarette and swerving all over the road.

I think it's a sort of testing the water type move, to see if people are so docile and pliable yet that they will actually accept this sort of utter none sense without mass disobedience, and/or ridicule.

I thought it was the case that it was fine to smoke in your car, however if you have an accident and need to claim/get the police involved then that is when you have the possibility of getting done for driving without due care / have insurance revoked etc?

Not sure though.

Under the new smoking in public places legislation, it's now an offence to smoke in a company car unless it is solely for your own use. If it is possible that it will be used by another employee, it is classed as a workplace and hence a no smoking zone.

Consequently, I have been guilty of this heinous crime at least 300 times since it came into force........

hehe

I've never been able to look at her on the screen without thinking about her sporting behaviour.

(The recipient wasn't driving; they were both 'engaged' on the hard shoulder, or a lay-by weren't they??)

But what I want to know is, if you have an accident, and the only thing they can prove is that you were smoking, does it become causal?

I can't see how without a strong suggestion that smoking actually caused the accident.

It's the kind of crackpot idea they'd suggest before being told by the police the lawyers and the judges that it's simply unworkable and insane.

That one is a no-no at any time, not just when driving.

Similar to the laws in Germany I would say. On certain areas, where there is no speed limit, it is not illegal to drive any speed. But if there is an accident, and it appears you have been driving fast, you are almost guilty by default unless you can prove otherwise.

The same with the smoking now here I would say. It is not illegal in a private car, but if there is an accident, and it can be proven you were smoking, it may be that there is an automatic weight in the case against you.
