Ok so what happens if:

1) Collision with another car; neither have insurance?
2) Collision with another car; one has insurance?
3) Collision with another car; both have insurance?

1) You're both screwed
2) The car with insurance claims, the other is screwed *
3) Both cars claim on their own insurance, and nobody is screwed *

  • It doesn't matter who is at fault

ultimately you drive at your own risk unless you have td insurance for your car.

many times though if you have coming together people come to and agreement assuming there is a clear responsibility

Thanks for the replies guys!

So suppose i have insurance, will they pay for out for the car i hit (if they dont have any insurance themselves)?

"many times though if you have coming together people come to and agreement assuming there is a clear responsibility". So if I hit someone and its my fault (if neither of us have insurance), does that mean I will have to pay for the persons car I hit aswell as my own?

And before you guys start to worry - I did have insurance on my recent TD. :P

Nope, your insurance will only pay out for the damage to your own car. Basically, everyone on a trackday is responsible for the damage to their own car, regardless of how it was caused. As a previous poster mentioned, if someone else causes damage to your car, they are not obliged to pay for it; you're reliant on their integrity/honesty to come to some arrangement.

Ok thanks for the info smile

What about personal injury? or is that waived when you sign the trackday document in the morning?

I don't necessarily think this is true. If you negligently cause damage to another car or injure someone then you might well be liable.

i am not a solicitor i can asure you but looking at previous cases or attempts to sue it seems that it comes down to the fact that motorsport is a dangerous activity and the courts seem to take the view if you enter into it you do so at your own risk, like any other sport indeed, even footy,

BUT

if you were to injur a third party (go of track and into somebodys garden and run over them whilst thay are sunbathing) or you negligently turn the wheel and drive round the track the wrong way into other cars NOT acting as would be reasonable on track, you could be strung up, but otherwsie the court seem to say bu**er off.

i have always driven my car with the idea of getting it home in one piece
i only ever drive at 90% and if i think someone is going to make contact with my car i will
do all i can to get out of there way. also i tend to try and find quiet days to go on.
i know that some tracks for insurance cost more than others my Mg at the ring on a RMA day cost me
£475 last year for two days and bedford a few months ago cost me £116 for a day so i think it
also depends what TDO you go withtypejust shop around

Quite often it's the rolling chassis i.e. engine isn't covered if it goes bang after downshifting at 100mph into 2nd gear.

I'm not sure how I would react in this situation. I'm a reasonable guy that wants to do the "right thing" in any given situation, but if I'm on track I don't expect to get money if someone by their fault causes me to incur damage.

That's what I "sign up to" on a track day.

So neither do I expect to have to come to an agreement on another's damage through my fault as they have "signed up to" the same as me.

I'm not talking negligence. I'm talking about fault being easily attributable to one party.

Bert

I agree entirely - the courts will assume that all drivers take on a certain level of risk. However, a driver could still be liable for damage / injury if their actions were sufficiently negligent. As indeed is the case with football!
