This has been ongoing for 7 months now. Basically got flashed coming out of nightsbridge on xmas eve 5pm! Anyway the notice arrived on the 11th Jan - post dated on the 10 Jan. The letter was dated the 4th but obviously they can back date notices just like we can set a date to anything we like on a PC.

So I've sent various letters, together with proof of the dated envelope. All I kept getting were increased fine notices. No acknowledges of the letters that I sent them. I spoke to them each time and each time I sent another letter in. Finally over the phone they asked for the actual envelope with the post mark. I sent this recorded delivery and it was signed for. A few weeks later I chased it and they denied ever receiving it !!

ANyway I kept a copy and faxed this to them in May.

Today another notice turned up (now increased to £120).

I know I was in the bus lane but the notice wasn't served within the 14 days that they have to issue it.

THe point of contention is, whether issuing the ticket and letting it lay around an office for 6 days and then post it qualifys it as being issued on the 4/01/03 or because it was actually posted on the 10/01/03 that it falls outside the 14days period.

Just feel that someone should make a point as long as its wineable

I agree. Dont just roll over and pay them. If theyre using dubious practices to get people to pay, even when theyre out of time, then they should be brought to task for it.

Well if they're allowed to postdate, presumably you are too. Simply write them a cheque for the original fine amount and postdate it back to a few days after the offence.

Problem solved.

One of our friendly and helpful BiB can probably confirm this, but IIRC it has to be 'served' (I think this is the correct term) within the 14 (+1) days, this means it has to be posted by at least first class mail by the 15th day following the infraction. 24th December means by 8th January. Posting date later than this is too late, don't give up.

Chase the original envelope, find out from the PO who signed for it etc.
