My Chim has turned into a Diesel Alfa Spider whilst in for repair furious Would have preferred a bloody MX5. Told the Ins to come and get the thing and stop taking the piss. FFS.

Is it unreasonable to expect anything better?

Brand new. Drove it 10 meters to park it and totally hated it! What is the point in an ENGINE START button on a slow very heavy diesel car?

No offense but this is exactly the reason I used anniesdad in each of my cases. First time had a brand new (new shape) SLK with 50 miles on the clock, second time a Boxster. I also know people who have had a Merc CLS & Porsche 911 - personally I'd insist on 'like for like' which to me the closest would be Porsche (closest being new cars that they'd be likely to have on their fleet.) Pricewise the Chim would have been pretty much a direct competitor for a Boxster so may be worth trying to point that out to them and asking what they'd have let you have had your car actually been a Boxster!

All fair and well, but Anniesdad deals with non-fault cases. The other party in my claim is saying i was speeding. Now got to prove non fault. Or rather they would have to prove fault?? I am completely 100% in the right and will go to court if necessary to resolve blame. I was going through Angel assistance. Now ditched them and going through another assistance company allocated by my broker. SHould get a better car through them. Getting wound up about the accusal of speeding. Dont really care about the hire car. But i will not be accused of something that was not my fault.

I really hate it when people try to wriggle out when they're clearly at fault. It'll be a heck of a lot harder for her to claim you were speeding than for you to prove she pulled out in front of you & besides that unless you wee travelling at warp speed she should have still seen you and judged your speed etc and distance to her.
Steve has helped countless PHers in cases similar to yours and is certainly not adverse to taking other parties to court as I know all too well. He helped me out on one that no other company would touch, taking the AA to court over damage sustained to my Chim beng transported back to the UK with a broken clutch. They denied responsibility from the outset and it took over a year to get full acceptance of liability and pay out. The service I got from him was fantastic and he went WELL beyond what he needed to to ensure a correct outcome. This is the main reason I'll recommend his above and beyond any other company that ofers this type of service. Sorry if it sounds like I'm selling him - I'm not but it may be worth a chat with him to see what he thinks of your case!

Thanks Zippee. If i dont get anywhere under A-plans guidance over the next few days i will take matters into my own hands and get him involved. Feel sick with anger.

Yes, I can imagine that. I'm angry and I only met you once!! (last Sunday)

Look, you don't have to prove anything other than she failed to exercise due care when entering the road and drove across the front of your car apparently failing completely to see you. (Did her vehicle have tinted glass/heavily tinted glass??)

From the position of your car relative to the junction (even assuming you entered the road by the slip road appearing on the right of your picture) such an accusation fails any test of liklehood/reasonablenss. Further, she would have to demonstrate some ability to accurately judge speed viewed from the position of her vehicle. A complete non-starter although saying you were speeding is probably the first (and least inteligent) thing she could think of saying in mitigation. Committing perjury (if it came to that) by maintaining that would probably be a completely different matter. Nick.
