a friend was caught doing 40 in a 30 area. the copper said if she was doing 39 he would have let her off with a caution. is there anything she can do that might get her off the fine with regards to the coppers comments?

No. ACPO guidelines state 35mph to 49mph in a 30 limit would normally get a FPN, 50mph+ would normally get a summons. It also says that these figures are up to the discretion of the officer(s) in each case.

Only thing you could do is complain about the officers comment. This though WILL NOT get her off the hook - sorry
