Saw a Motorcycle (BMW) going up the M1 the other day and noticed that he travelled about 200m then kept pulling over onto the Hardshoulder.Thought that i would stop and have a word just in case he was having trouble with the Bike.

Well i was correct, he was having trouble but not with the Bike, it was his Cigarette.....it kept going out.

It took me by surprise and even more so when i realised that he wasnt pissed......just a typical BMW rider i guess.

At least he had the sense to wear an open faced helmet!!

Saw a guy about a year or so ago smoking on bike (BMW again) but whilst riding in town, would have thought the cig would burn very quickly.

But have seen many smokers riding in Italy, mainly on scooters and mopeds in fact even had a guy on a vespa ask me (in a car) for a light whilst slowing down for a red traffic light.

Incidentally what's the legal situation of smoke-riding?

Yes we did...thank God for Honda.
On a legal point of view - No offence.

Hmmmn. Anyone else find it incongruous that its OK to smoke on a motorcycle but using a mobile phone in the car is to become an offence?

Funny old world isn't it?

Whats wrong with smoking whilst driving? Not as if theres a law against using your mouth for something else whilst driving, or most women would get automatic bans wouldn't they?

Presumably though stopping on the hard shoulder to light the cigarette is an offence? After all its hardly an emergency!

If I was driving a convertible and it started to rain and I pulled over on to the hard shoulder to put the hood on is that an offence?

Technically it's not an emergency but I believe it would prejudice my ability to drive safely. Especially as my glasses don't have automatic lens wipers!

Would it depend on the sort of day the bib was having?

Slightly off topic but............If driving whilst using a mobile is a no no........without due care and attention and all that legal stuff........why isn't driving with the mother-in-law for the same reason ??
(All that, "and Doris said this", "And I said, "she didn't did she?", and Thelma said, "she did you know" and I says "What" you know, with my hearing being bad and all......etc....etc.....etc)

Ive argued this point at work a few times and im correct in saying that it is an Emergency.
I drive convertibles and would not hesitate to pull over to a safe place (if you can call a hard shoulder a safe place) to put up the hood and stop me panicking about both me and my car getting wet.

I would like to see a Trafpol stand up in Court and argue that it wasnt an Emergency.

I have issued a ticket to a motorcyclist riding (with helmet balanced on top of head) and talking on mobile at same time....he couldn`t see any problem with the way he was riding.
We couldn`t believe it!!!!
