Tyres are old....... how old?

Are they legal as far as the amount of tread on them?

Does it do it when going over speed humps?
E46 M3's are notorious for snapping springs, check to see that your not sitting lower on one side and that you havent lost any coils in the spring.
If you have then your tyre may be rubbing on the wheel arch.

Sorry just re-read, you say the springs are fine.

At work we have an octavia 4x4 which was making exactly this noise when turning 90 degrees right out of junctions.
The mechanics flushed the rear diff fluid 4 times and refilled. The noise has totally gone.

It definatly sounds like the diff, as you have a warranty let BMW investigate.
250 pounds excess for a new diff is worth it, especially as it is another weak spot on the E46.

itis just on the line si it needs to be changed soon but ?? do you think thatis what cause the noise?

Not likely unless they are unevenly worn.
Ie - if you have one bald tyre and one new on the back two wheels you can get 'diff wind up' owing to its limited slip nature. This can cause damage to diffs quite easily.

Try changing the diff oil.

How much BMW would charge to do this, I have no idea. Maybe worth your mechanic going it.

Doubt it, I expect the dealer just wants to make a few hunderd pound out of stupidly over priced tyres before having to look at anything remotely difficult.

No, just checking, as if they are worn unevenly or, worse are showing any chord then that would probably be the cause, although a set of Dunlops that I ran recently started to hum and vibrate when down to 3mm.

I would also say it's diff related.

Sounds like my M roadster did almost the same. Had the diff oil changed during last inspection. now its 'quiet' again.

sounds like diff plates rattling when cornering . change diff oil with correct spec oil and if that does not work add some friction modifier and that will sort it
