I got caught by a camera van on a bridge in December 2002 doing 86mph in a restricted 50mph area of the M2 in Kent. Only had the car a month, so DVLA had the previous owners details for the plod to send the NIP to... 2 months later and I get it.

Before reading any of these sites, I put my hands up to it AND SIGNED THE FORM (damn, damn, damn!!!).

No fixed penalty offered, only to go to court. So I fill in the summons on arrival and tick the box to plead by post. Expected costs are mentioned as £35.

I had 6 points about 10 years ago, 3 for speeding in a 30 (36!) and 3 for parking in a zebra controlled area (newbee plod!!! grrr..). So basically have a clean sheet.

1st August the case was heard... and the magistrate adjourned it! I was expecting 3-6 points and 200-500 quid fine. I spoke to the listings clerk for the court and they told me the magistrate is thinking of banning me!

Can anyone give me clues as to what I might expect?

For info, the road was clear, with light traffic. The statement from the camera man states the same. It was 10.30am in the morning, so rush hour was past... 3 lanes were open and the only coned area was the hard shoulder and no workmen were in sight .

Thanks in advance.

Mike

36mph over the posted limit = Ban, I reckon. Get the usual - letter from employer stating you need your car for your job, all that stuff, and plead insanity, be very, very, very contrite, say you're sorry etc.

They do target roadworks, and it's sensible to do the posted limit or just above - speeding over short sectons of works will only shorten your journey by 30 seconds, and it's best to do what everyone does, and blast it after the NSL sign!

As nubbin said

They were covering those roadworks very heavily (sp) indeed the bridge over the River one day had two Gatso's for each direction and a Talivan

Which was an ar5e to spot because it was parked on the new bridge (with all the contractors cars)

edited cos i hit the wrong button

Can only backup the other contributors:

Take your boss to court if you really need your car for work - I used to help administer one of the country's largest car fleets (mostly sales) and that normally got a 2-4 week ban.

Bottom line is don't speed in 50mph motorway roadworks - they are almost always targetted.

And don't park on a zebra crossing or on zig-zag lines, you'd even be booked for farting near one if they saw you!

I was done in almost exactly the same circumstances...M1 roadworks, 3 full lanes, no workmen, hard shoulder coned off. 81 in a 50.

Went to court with ~100 other people caught on the same two days (duty solicitor's estimate) and we all got the same - 150 quid and 4 points. I'm guessing the magistrates weren't overly impressed with the police tactics and gave us all the minimum they legally could.

Dunno if you'll be as lucky, particularly if they adjourned, but you never know!

I'm afraid I'm getting fed up with reading some of these stupid posts. If there is a speed limit sign with a red circle around it, OBEY it. I know its a pain in the @rse, but so is the hassle of fines and points etc. In a 50 zone, 60 is pushing it, 80 plus is just plain ridiculous. Stop moaning, open your eyes and drive properly. When on a nice A road, get the Geodesy on the dash, jammers in the grille, and enjoy yourself. Far less chance of getting caught this way than on a targetted motorway! Can't you tell I live in Northants!

The Magistrates Guidelines (a year ago) said

For travelling up to 10 mph faster than a 20-30 mph speed limit or up to 15 mph faster than a 40-50mph speed limit or up to 20 mph faster than a 60-70 mph speed limit the guidelines suggest that the magistrates endorse with 3 penalty points.

For travelling between 11 and 20 mph faster than a 20-30 mph speed limit, or between 16 and 25 mph faster than a 40-50 mph speed limit, or between 21 and 30 mph faster than a 60-70 mph speed limit, the guidelines suggest that the magistrates endorse with 4 or 5 penalty points.

For travelling between 21 and 30 mph faster than a 20-30 mph speed limit, or between 26 and 35 mph faster than a 40-50 mph speed limit, or between 31 and 40 mph faster than a 60-70 mph speed limit, the guidelines suggest that the magistrates endorse with 6 penalty points or consider disqualification for between 14 and 56 days.

You should note that these are only guidelines and the magistrates can deviate from them.

As far as fines are concerned speeding carries a maximum fine of £1,000 (£2,500 if speeding on a motorway). The guidelines also lay down fines which are very much dependant upon your income

Finally got dragged in front of the magistrates yesterday.

Final result: NO BAN! 6 points, £300 fine, £35 costs.

I had the letter from my firm saying I needed as my job involved 'on call' etc..

Hardest part is standing in front of the 3 mag's and being asked 'why you did it...' ermmmm

Anyways, a bit of info for the masses.

Kitemike - I bet you had a hard time with that question.

Being in court and avoiding being pedantic is a hard act to do!

I had something very similar 5 years ago.

M2 Kent, 87 in a 50, cones on hard shoulder, no workmen.

I was given the choice between 6 points and a 200 fine, or a 7 day ban and a 200 fine.
I chose the ban...

I would say you got the heavy-hand treatment maybe as a result of not attending court originally with a brief and feigning regret.

I was done for 104mph in a DC-70, attended court with solicitor and got £300 and 21 day ban, no points, no costs awarded as a result of pleading guilty. This was in April 2002 before the craze for not signing.

So how do the short term bans affect insurance in the future? Does it hit harder in the pocket than points?

not in my experience, they are still SP30s and if they carry no points, it can be better in some cases.

The problem with getting points , 6 in your case, is that your nearer to a mandatory 12month (i think) ban if you tot up to 12 points, as opposed to a short, 21 day ban, in my case.
