end of year paye returns
Discussion
Probably.
I have continued to handle my clients' P35s the "old fashioned way" on paper up to and including this year.
However, in two year's time electronic filing will become compulsory for ALL employers (even if they don't possess a computer!!!) so next year I plan to launch into the no doubt perfect brave new world of "electronic filing".

I spoke the the online helpdesk ( interesting use of the word help) and they said yes everyone has left it to the lst minute so its a bit slow...
Shock horror, you give out a deadline and everyone does it the week before... Im sure the govt think we all sit around on a huge pile of cash doing bugger all, and have loads of time to fill in their fecking forms as we have nothing else to do

That's EXACTLY what they think. They cannot understand that fulfilling their bureaucratic requirements aren't of the highest priority for business.
We're all in the same boat. I've had to complete about 30 plus P35s for various clients over the past three weeks or so. When you think about it, the window from 6 April 2008 to 19 April 2008 is not that great when you have other business priorities to attend to.
Also, there have been some subtle changes to the "tick box" questionnaire section on Page 4 which have massive ramifications - particularly in respect of the IR35 related question. All the accounting and tax bodies have queried the Revenue as to what they actually mean by the new style question but so far they have refused to clarify what the correct answer should be. As a result, many P35s have been delayed whilst employers and their advisors ponder this dilemma.

I take it that question 6
Are you a service Company?
If yes, have you operated the intermediaries legislation ( sometimes known as IR35)
well we supply services and goods so im going to say no...
I did have a revenue inspection a few years ago that was essentially an IR35 fishing expedition.
after spending 9 months and lots of their time they decided we weren't subject to IR35 then...phew..

The problem is that they have changed the expression "personal service company" to simply "service company". IR35 was only ever to be applied where "personal services" supplied by an individual were supllied through an intermediary (a limited company or partnership) instead of by the individual person in question. Are you a service Company?

There are many "service" companies to which IR35 would never apply but the P35 is now asking "service comapnies" without exclusion to make some sort of declaration that they did or didn't apply IR35.
So the correct answer, to my mind, is YES, I am a service company (it doesn't say on the question that you have to be 100% services only) but NO, I don't operate IR35.
I think ALL companies that supply services as part of what they do should have answered like this because they then would have swamped the Revenue with so many "Yes" answers that they would never have the resources to check out the "problem" IR35 companies drowned out by such a huge number of "positive" answers. Indeed, it would be hard to identify the genuine problem companies because virtually EVERY service company would be a problem company.
I really do believe that The Revenue have lost the plot big time these days.
