Morning all, I want to start my own company soon and for various reasons, I want it to be a UK Limited company rather than the German equivalent (GmbH). I know that this is perfectly possible from a Companies House / UK point of view - I will need to establish the company in the UK with a UK registered address etc -all of that's quite straightforward enough, there are plenty of companies that will serve as a registered address for that purpose.

What I need some help or advice with is the question of actually operating in Germany. Has anyone out there any experience of this? In particular I'm interesting in finding out about taxation and legal requirements. My understanding is that the company would be subject to UK law as it would be a UK registered limited company but tax would be payable in the country of the company's operation. Anyone know if that's correct?

Just for clarity, the company will not actually trade from the UK, it will be a one man band operation, operating from home which will be in Germany although some clients may well be located within the UK. (The company will offer training services and will travel to clients).

Cheers for any help...

You will need to talk to both a German and a UK accountant (maybe a UK firm with German offices). A set up like this will be complictaed from a taxation point of view and you will need access to tax information for both countries.

You will also need tp clarify the the personal tax implications as well.

Thanks Eric, I was expecting that would be the case, I'll have to see about finding suitable accountancy firms to chat with. Anyone you'd recommend in the UK?
Cheers

I would expect you would have to approach either a mid-tier or top tier firm to find that type of international tax expertise. This, of course, could be expensive as they are not the cheapest professionals to deal with.
