FPN acceptance deadline.

On 9th August I was issued with a FPN for crossing a solid white line. The PC, however, filled in the wrong offence code on the ticket. In a desperate attempt to wriggle out of the 3 points I was faced with I wrote to the Chief Constable saying that I had received legal advice to the effect that the incorrect offence code would weaken a case and that I should go to court. My letter then requested that, as an alternative, the whole matter be disregarded.
About 10 days ago I received a reply saying that my letter had been forwarded to the central ticket office "who have responsibility for policing matters of this type" and saying they would contact me in the near future. I haven't heard anything to date and 28 days from issue of the ticket expires this Friday.

My question is: Does the fact that I'm awaiting a response from them have any bearing on the 28 deadline?

Also there's also no info on the ticket regarding how I go about surrendering my license (because I showed it at the side of the road) - it doesn't look like it'd normally go to the same place as the ticket and the fine can't be accepted until it's surrendered. If I decide to accept the fixed penalty should I surrender my license to my local police station?

I would take the personal view that as you (or your mate) are in correspondence with them the deadline should be ignored. However, they could also argue (under contract law) that you are now making them an offer, thus cancelling their original offer.

I would suggest that if there is a deadline, then it remains a deadline that must be met unless an alternative agreement is reached within that deadline.

Simply because you are in dispute doea not release you(mate) from your legal obligations.

All IMHO.
