NIP just recieved in my wife's name (she's about to take her test as a driving instructor). I went to look at the area again today. Entering the village is a 30mph sign, roughly 1/3 mile later is a black on white camera sign, another third of a mile down is the bottom image on the website below:
www.safespeed.org.uk/badsigns.html
This states it is a valid sign but not a valid terminal sign. A further 1/3 mile down the road was a Truvelo speed camera with yellow reflective facing and three very scruffy lines on the road. Is the invalid terminal sign enough to get the NIP dropped, and if it is how should the NIP be completed?

Edited to add that the NIP was for doing 40 in a 30

Possibly... I was told a story a couple of days ago about a couple of TrafPol that managed to get the case thrown out because the speed camera sign was invalid.

Assuming that you mean this one, , no, because it's not being used as a terminal sign.

Why are you trying to get off? Was the limit inappropriate?

I'm sure I've misunderstood this, but...

I can't see how the non-prescribed sign has anything to do with your case as you have already said the first sign on entering the village was a proper & valid 30mph sign.

Did you see some other sign to indicate the limit had gone up to 40 or so? If not the limit would still be 30mph and the camera sign is warning you of that!

The wifes worried about the points just as she's trying to become a driving instructor. I agree that the limit was clearly posted and there does'nt seem to be any confusion, however if there is a way to avoid points it would be useful to know

That's the one. Do you mean its not being used as a terminal sign as two seperate signs preceed it?

Sort of. Only the limit start and limit end signs are terminal signs. This sign appears to be being used for its prescribed purpose, a speed camera warning and speed limit reminder.
However, if there are street lights less than 183m. apart, you may wish to challenge the conviction on the grounds that that roundel itself in the sign(IIRC 880 in the TSRGDs) constitutes a 30 MPH repeater which is prohibited in the TSRGDs. It's a very much a long shot as the sign itself is prescribed, however, in the absence of anything else, you might want to give it a whirl.

If the signs are not prescribed it is not a case of 'getting off'. No offence has been commited in the first place. If no offence has been committed, why should he take the penalty; some warped sence of civic duty?

Just send the NIP back unsigned.

You've not 'tried to get off' with it, you have complied with the law. If the law is unable to take matters further, it's hardly your fault is it?

In that case, you might as well introduce a 'swear box', that you put £60 in every time you speed. You could set up a direct debit to the plods and save all the hassle of writing cheques out!

I'd be happy to, but the camera was a forward facing one. Could you get a way with it. The wife does not look like a Mr! or do they care?

They won't even look at the pics if you just plead guilty by post. If the issue was raised you just thought you were driving the car that day.

Personally, I'd do the legal thing and not sign the NIP's whilst making an offer to your wife to get those all to rare brownie points.
