Not quite as earth shattering as the introduction of compulsory helmet wearing in Spain, France will insist, from 1 September 2008, that all cyclists wear a hi-visibility vest outside of towns at night and in poor light. What’s more, the vest has to conform to a European standard.

I read it differently. "Also from September 1 cyclists will be required to wear high visibility jackets when outside towns, as well as during the night or when visibility is poor."
To me that means any time you are cycling outside a town, regardless of lighting conditions you must wear a high viz vest.
Wearing a high viz vest on an alpine climb would be torture.
