I own a flat in a large development which has a substantial carpark in the middle. Some of this carpark is marked with double yellow lines, but everyone parks on them because there it actually causes no obstruction. I always thought that because the area is considered private property that the traffic wardens have no juristiction here. However the girlfriend just got a parking ticket... The area can hardly be considered public highway which I thought was what they were supposed to police. Although yes she in theory shouldn't have parked there, does the Council have the right to issue a fixed penalty parking ticket here?

Cheers

If it is privately owned then no the council doesn’t have the right to issue tickets, you'll have to check as it could be public highway similar to a cul-de-sac or the roads around retail parks etc

What he said. Unless they have the permission of the landowner to do so.

Make sure it isn't a private ticket, made to look official, and asking you to send the money/fine to a PO box.

Thanks for the confirmations, I shall be sending a letter to the Council then...

Sounds like a public right of way across private land.
