Mother received a letter from Northern Parking Services saying she had committed an offense last year on 10th December - she was on holiday at the time.

The letter didnt even give a location or type of offense. This was followed by a reminder, which was followed by a letter from Daniels Silverman - debt collectors to these idiots.

Today the debt collectors got the standard "in dispute" reply and Northern Parking Services got a slightly modified version of Streakys letter...

My letter to the @rseholes said:
Subject: DO NOT IGNORE: Your reference XXXX

PLEASE TAKE NOTE, THIS IS A FINAL WARNING - FAILURE TO ADHERE TO THE CONTENTS OF THIS LETTER MAY RESULT IN LEGAL ACTION.

To whom it may concern,

Today I received a letter from Daniels Silverman in the form of a 'final demand'. Their reference WOL/Z80774.

As you would expect, I have told them that the matter is in dispute and informed that they should refer the matter back to yourselves, as their client - this is as per a previous email you would appear to have ignored.

Allow me to make myself clear.

As I am sure you are aware, it is the driver of the vehicle with whom any contract to park was made, not the registered keeper, in this case the registered keeper was Mrs. Janet Bergh. She was not in possession of that vehicle at the time and as I am sure you can appreciate, her records do not extend back to Monday 10th December 2007 and therefore she is unable to account for the whereabouts of the vehicle.

You will also be aware that the terms of any such contract must be set out in such a manner as to be obvious to anyone with whom you wished to make the contract. These terms must comply with all applicable contract law, such as the Unfair Contract Terms Act 1977.

Should you still with to pursue this claim, please supply evidence that the person parking the vehicle you allege to 'committed an offense' - an offense which remains unknown at a a location which remains unkown - would have had opportunity to read the contract terms.

Such evidence must be, as a minimum;

  • A detailed route and timings of the vehicle and its travel into and through the land you allege the offense was committed.
  • A detailed route of the drivers passage out of the vehicle and away from the vehicle up until the point they left the land you allege the offense was committed.
  • Photographs of all relevant signage in situ in locus in quo at the time of the alleged offense so as to show that there were actually signs present and that they were readable.
  • An accurately drawn and scaled map showing the location of each sign, indicating which signs you believe the driver would have had the easy opportunity to read (the routes of the vehicle and the driver should be superimposed upon this map).
  • Details of the weather conditions at the time, in particular the visibility - all to be confirmed by the Meteorological Office.
  • Sufficient details of the driver with whom you claim to have made a contract to enable their unique identification.
  • A detailed description of the processes followed to record and analyse the evidence of the alleged offense.
  • A notorised statement from a senior member of staff at the location to the effect that you recording and analytical systems were working normally at the time of the alleged offense.
Without the above, i regret to inform you that I cannot entertain your claim and any further demands WILL be considered as harassment and will be reported to the police with a view to your criminal prosecution under S1 of the Malicious Communications Act 1998, S85 of the Postal Services Act 2000, S127 of the Communications Act 2003 and/or S2 of the Protection from Harassment Act 1997 - the last one with a view to the court issuing a restraining order against you.

Additionally, civil action will be taken against you personally and your employer to cease and desist and also for the recovery of all costs, together with a substantial payment in compensation for the mental pain and suffering caused.

I expect your reply in return, either providing the evidence requested above or indicating simply your termination of any further correspondence.

For and on behalf of ab@'s mother.
I love playing with these people.

I received something similar, £70 parking fine months after I alledgedly parked in Aldi for more than 2 hours, few days later a letter from a debt collection agency. SP&tL had a template that I used copied to both companies, not heard a peep since biggrin

It'd be good if there was a 'useful letters' section of pistonheads where we could keep these bad boys

Seem to be getting quite common now. More like a scam than 'parking enforcement'. I wonder how many people just pay up on the assumption they are have to, regardless of guilt.

Nice One AB

Below is a little extra I added to my letter to these leeches, just to wind them up of course. Never heard another thing from them.

Should you choose to send further correspondence on this matter it will incur a charge from me to Parkforce of One hundred pounds per letter. Your acknowledgement and agreement to pay these charges will be assumed by further correspondence from yourselves henceforth.

Yeah, i noticed that after I had sent it. I was using my Macbook and have recently done a full reinstall on it, so it's back to 'Americanized' spelling.

I just ignored the letter from the debt collection agency, who are apparently owned by Barclays.

Not heard anything further for 9 months or so although the second letter in a fortnight gave me a week to pay.

Reply saying that that they cant deal with me and to get my mother to call them, as without hearing from her direct they are unable to deal with my email, due to the data protection act.

This right?

I know the right thing to do is to ignore this, but I find myself wanting to cheese them off further.
